SO THIS WILL BE A PUBLIC HEARING HELD FOR THE PURPOSE OF GIVING ALL INTERESTED PERSONS THE RIGHT TO SPEAK AND BE HEARD.

THIS LAND IS ACTUALLY OFF OF THOMPSON ROAD AND IS LANDLOCKED.

WE DO HAVE A DEVELOPER WHO IS, UM, GETTING READY TO DEVELOP THE PIECE THAT'S IN THE CITY THAT HAS FRONTAGE HERE.

I GUESS THIS STUFF'S NOT WORKING TODAY.

UM, AND WOULD LIKE TO BRING IN THAT ADDITIONAL THREE ACRES.

UM, RIGHT NOW THEY'RE LOOKING TO DO A, UH, THEIR BUSINESS IS T-REX AND THEY HAVE HEAVY EQUIPMENT RENTALS AND SO FORTH.

UM, AND THEY ARE ALSO GOING THROUGH A REZONING APPLICATION WITH THE PLANNING ZONING COMMISSION TO REZONE THIS LAND INTO THE LIGHT INDUSTRIAL DISTRICT, WHICH IS SURROUNDING THIS PROPERTY.

UH, THE SECOND ITEM IS THE SERVICE AGREEMENT.

UH, AS YOU KNOW, WITH OUR ANNEXATIONS, WE DO SERVICE PLANS AND THEN SERVICE AGREEMENTS WITH THE PROPERTY OWNER JUST TO OUTLINE WHAT SERVICES THEY WILL BE PROVIDED ONCE THEY'RE WITHIN THE CITY OF BAYTOWN.

SO BECAUSE OUR RATES ARE SET BY ORDINANCE, WE ALSO NEED AN ORDINANCE FOR YOU TO, UH, MODIFY OUR CHARGING THE RATES BETWEEN THOSE HOURS.

UH, THE STUDY WAS LAST UPDATED IN 2016, UM, TYPICALLY UPDATED EVERY FIVE YEARS.

SO THE NEW STUDY WILL LOOK AT THE 2021 THROUGH 2031 PROJECTIONS.

CONSIDER AN ORDINANCE AUTHORIZING A VARIANCE TO SECTION SIX DASH TWO OF THE CODE OF ORDINANCES TO ALLOW A PROPOSED, A PROPOSED SPORTS BAR AND LOUD LOUNGE TO SELL ALCOHOL FOR ON-PREMISE CONSUMPTION WITHIN 300 FEET OF A CHURCH LOCATED AT 5 0 1 WEST MAIN STREET, UH, BAYTOWN, TEXAS HARRIS COUNTY.

UH, SO WITH THAT, MS. BRI, I THINK YOU HAVE AT LEAST SOME ADDITIONAL COMMENTS.

SO, UM, THIS IS THE SECOND TIME I'VE BROUGHT A, A VARIANCE REQUEST TO THE DISTANCE REQUIREMENT IN OUR ALCOHOL CODE BEFORE YOU, IN THIS PARTICULAR INSTANCE.

UM, WE RECEIVED AN APPLICATION IN NOVEMBER OF 2019 TO OPEN A BAR AND GRILL AT, UH, 5 0 1 WEST MAIN, WHICH IS LOCATED RIGHT DOWN THE ROAD PAST, UH, 1 46.

UM, IN OUR DUE DILIGENCE, WE, WHEN WE RECEIVE A PREQUALIFICATION PACKET, WE SEND IT TO FIRE, UH, BUILDING AND PLANNING TO CHECK A NUMBER OF THINGS.

UM, THERE WERE SOME DELAYS IN GETTING IT APPROVED.

THERE WAS TROUBLE GETTING INTO THE BUILDING, SO IT TOOK FIRE A LITTLE BIT.

AND WHILE WE WERE GOING THROUGH ALL OF THAT, THEY DID A REVIEW OF THIS PARTICULAR APPLICANT AND IT DID NOT MEET THE DISTANCE REQUIREMENTS.

SO IN JANUARY, WE DENIED THE APPLICATION BECAUSE THERE IS A CHURCH DIRECTLY ACROSS THE STREET FROM THE PROPOSED, UM, BAR AND GRILL.

UH, WHEN WE DENIED IT, WE SENT THE APPLICANT THE INFORMATION, UM, AND GAVE HIM THE INFORMATION ON REQUESTING A VARIANCE, UH, TO YOUR DISTANCE REQUIREMENT.

THE DISTANCE REQUIREMENT IN OUR CODE IS 300 FEET FROM DOOR TO DOOR USING PROPERTY LINES, AND IT DOES NOT MEET IT IN THIS PARTICULAR INSTANCE.

CAN YOU, WOULD YOU MIND SHARING WHAT THE FOOTAGE IS? IT'S FROM DOOR TO DOOR.

IT'S LIKE TWO HUNDRED AND FIFTY, TWO HUNDRED THIRTY.

IT'S WAY BELOW THE 300 FOOT.

I DO WANNA POINT OUT THAT IN 2016, UM, THERE WAS AN ALCOHOL PERMIT ISSUED AN ERROR AT THIS PARTICULAR LOCATION, IT EXPIRED IN FEBRUARY OF TWO, UH, 2019.

THERE IS A 30 DAY WINDOW TO RENEW AN EXPIRED PERMIT WITH THE STATE.

THAT DID NOT HAPPEN.

THE APPLICATION CAME IN IN NOVEMBER.

SO IN THIS PARTICULAR INSTANCE, THERE IS NO GRANDFATHERING OF ANY KIND WITH THIS APPLICATION.

IT HAS TO BE SEEN AS A COMPLETELY NEW APPLICATION, INDEPENDENT ITS, AND ON ITS OWN AS SUCH, ALL OF OUR CURRENT CODE AND DISTANCE REQUIREMENTS HAVE TO BE, UH, TAKEN INTO CONSIDERATION.

AND BASED ON THE INFORMATION THAT WE HAVE FROM THE TIME THAT IT WAS RECEIVED, IT DOES NOT MEET THE DISTANCE REQUIREMENT AND IT CAN ONLY MOVE FORWARD IF COUNSEL GRANTS A VARIANCE TO THE DISTANCE REQUIREMENT.

UH, I WANNA CALL OUT AND, UH, COMPLIMENT, UH, FOUR OF OUR FIREFIGHTERS AND, UH, ENGINE COMPANY, UH, STATION ONE, MIKE WILLIS, CHRIS CRANE, DANIEL CALHOUN AND CHLOE MATULA.

AND ACTUALLY I HAVE A VERY SPECIAL LETTER HERE THAT I'M GOING TO READ FROM A LINDA HOSKINS.

NO, I'M JUST KIDDING.

THERE IS A RELATION THERE.

IT SAYS I, I HAVE TO GIVE THIS STATION A KUDOS FOR THEIR HELP TODAY, MAY 27TH WHEN THE ELEVATOR WENT OUT AND TRAPPED A SENIOR RESIDENT AT AT LEAST 15 MINUTES.

THIS IS THE FOURTH TIME IT HAS GONE OUT THIS YEAR.

NOW THIS TIME THERE WAS A RESIDENT IN THE ELEVATOR THANKS TO THE BAYTOWN FIRE DEPARTMENT STATION ONE, THE RESIDENT WAS RELEASED SAFELY.

THESE FIREMEN WENT WAY BEYOND CALL OF DUTY AND TRYING TO FIX OUR ELEVATOR HERE AT BIRDSONG PLACE VILLAS, AND WAS HERE FOR OVER AN HOUR TO HELP US.

THERE WERE TWO PEOPLE FROM THE THIRD FLOOR AND TWO FROM THE SECOND, INCLUDING MYSELF THAT NEEDED TO GO UPSTAIRS TO THEIR HOME AND NOW HAVE TO CLIMB THE STAIRS AGAIN.

THESE GUYS ARE SUPERHEROES, UH, TO THE SENIORS NOW.

AS, AS WE GET CLOSER TO OUR, UH, TO OUR MEET AND CONFER OUR COLLECTIVE BARGAINING, WE'D LIKE TO LEAVE OUT WORDS LIKE SUPERHEROES AND THINGS LIKE THAT.

WE, IS IT, YOU KNOW, THAT, THAT JUST COMPROMISES OUR NEGOTIATING.

AND OUR MAINTENANCE MAN CAME BY, LOOKED IT OVER AND LEFT BEFORE THE FIREMAN EVEN STARTED.

AND THEY NEEDED INFORMATION FROM HIM.

BUT I GUESS HE WOULDN'T COME BACK.

BUT FIREMAN DANIEL TOOK CARE OF THE ISSUE FOR THE ISSUE OF THE ELEVATOR.

DANIEL AND MIKE SAID TO CONTACT YOU AND THEY'D HAVE ALL THE INFORMATION YOU NEED.

UH, AND THIS WAS DIRECTED TO OUR OWN COUNCIL MEMBER HOSKINS.

UH, AGAIN, KUDOS TO MIKE WILLIS WILLS, I'M SORRY, CHRIS CRANE, DANIEL CALHOUN AND CHLOE MATALA.

UH, WE'RE VERY PROUD OF 'EM, DEMONSTRATING OUR CORE VALUE OF CARING.

AND IF I MAY SAY ONE THING THAT THEY GOT THIS, THESE PEOPLE OUTTA THE ELEVATOR AND THEY, THEY WERE TOLD ABOUT THE PROBLEMS THEY'VE HAD WITH THIS ELEVATOR.

SO THOSE FIREMEN STAYED AROUND TO SEE IF THEY CAN'T FIX IT.

THAT'S WHAT THEY WERE DOING THERE FOR, FOR SO LONG.

SEE IF THEY CAN'T FIX IT THEMSELVES BECAUSE THE MAINTENANCE GOT LEFT.

AND SINCE THEN, THE OWNER OF THE APARTMENT HAS COME AND FIXED THAT ELEVATOR AND IT IS FUNCTIONAL NOW.

AND SO THEY DID MAKE A DIFFERENCE.

YEAH, THEY, THESE GUYS CAN FIX JUST ABOUT ANYTHING.

BY THE WAY, THEY GOT A BIG AX.

ALSO WANTED TO CALL OUT, UH, ROBERT LOPEZ FROM FIRE STATION.

UH, TWO, UH, THEY WERE DISPATCH TO WOMAN HAD COLLAPSED DUE TO HEAT WHILE MOWING THEIR LAWN.

SO GUESS WHAT FIREFIGHTER ROBERT LOPEZ DID? YEP.

SO RIGHT HERE HE FINISHED THE JOB.

SO AS I WROTE HIM A THANK YOU NOTE, I TOLD HIM, YOU KNOW, IT'S REALLY NOT ABOUT MOWING, IT'S ABOUT SOMETHING A LOT MORE IMPORTANT.

AND THAT SAID AGAIN, DEMONSTRATING CARING FOR OUR, FOR OUR RESIDENT.

SO HATS OFF TO HIM.

ALSO WHILE WE'RE AT, THIS IS A FIRE DEPARTMENT EVENING, BY THE WAY.

WE HAVE THREE, UH, CERTIFICATES THAT WERE EARNED, UH, FROM OUR FIRE DEPARTMENT.

FIRST OF ALL, FIREFIGHTER HAYDEN PHILLIPS STATION THREE EARNED HIS INTERMEDIATE STRUCTURAL FIREFIGHTER CERTIFICATE.

FIREFIGHTER JEFFREY SMITH FROM STATION TWO EARNED HIS INTERMEDIATE STRUCTURAL FIREFIGHTER CERTIFICATION.

AND LIEUTENANT JEFF KELLY FROM OUR FIRE MARSHAL'S OFFICE EARNED HIS INTERMEDIATE FIRE INVESTIGATOR CERTIFICATION.

SO CONGRATULATIONS TO ALL THESE GUYS IN RED, APPRECIATE THEIR DEDICATION, THEIR ENERGY, THEIR CARRYING, AND MAKING US LOOK GOOD.
