CITY OF BAYTOWN NOTICE OF MEETING CITY COUNCIL REGULAR MEETING THURSDAY, MAY 10, 2018 6:30 P.M. COUNCIL CHAMBER, CITY HALL 2401 MARKET STREET, BAYTOWN, TEXAS 77520 AGENDA CALL TO ORDER AND ANNOUNCEMENT OF QUORUM PLEDGE AND INVOCATION Council Member Heather Betancourth, District No. Four

1. MINUTES

a. Consider approving the minutes of the City Council Work Session and Regular Meeting held on April 12, 2018.

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS

a. Mr. Robert Mullins has requested to appear before the City Council regarding traffic signal sensors at certain intersections that do not detect motorcycles.

b. Present a proclamation designating May 20-26, 2018, as Public Works Week in Baytown.

3. PROPOSED TEXT AMENDMENTS TO THE ULDC

a. Conduct a public hearing regarding proposed text amendments to the Unified Land Development Code to amend the current requirements for the hotel land use in the City of Baytown.

b. Consider an ordinance amending the Unified Land Development Code regarding current requirements for the hotel land use in the City of Baytown.

c. Conduct a public hearing regarding proposed text amendments to the Unified Land Development Code and Chapter 18 "Building and Building Regulations," of the Code of Ordinance, City of Baytown, Texas, to amend the current requirements for self-storage and outdoor storage land uses in the City of Baytown and to include a transition buffer zone.

d. Consider an ordinance amending the Unified Land Development Code and Chapter 18 "Building and Building Regulations" of the Code of Ordinance, Baytown, Texas, to change the current requirements for self-storage and outdoor storage land uses in the City of Baytown and to include a transition buffer zone.

e. Conduct a public hearing regarding proposed text amendments to the Unified Land Development Code to: (i) require certain accessory buildings in non-residential zones to meet masonry requirements; (ii) require masonry for Light Industrial and for buildings along certain rights-of-way; (iii) alter the masonry reduction process; (iv) clarify the standards where variances may be granted; (v) amend the findings necessary for administrative variance approval; and (vi) add and amend definitions.

f. Consider an ordinance amending the Unified Land Development Code to: (i) require certain accessory buildings in non-residential zones to meet masonry requirements; (ii) require masonry for Light Industrial and for buildings along certain rights-of-way; (iii) alter the masonry reduction process; (iv) clarify the standards where variances may be granted; (v) amend the findings necessary for administrative variance approval; and (vi) add and amend certain definitions related to the above-referenced matters.

4. CELL TOWER APPEAL AND SPECIAL USE PERMIT

a. Consider Vertical Bridge's application of appeal concerning setback, fall zone and platting requirements contained in Chapter 21 "Cable and Telecommunication Regulations," Article III "Telecommunication Regulations" of the Code of Ordinances, City of Baytown, Texas, for the property located at 2402 2/3 Shady Hill Drive, more particularly described as Reserve "B," Rollingbrook, Section 4, Harris County, Texas.

b. Conduct the public hearing regarding a request for a Special Use Permit for a proposed cell tower, 100 feet in height, on a tract of land approximately 0.13 acres of land being part of and out of 10.61 acres, zoned General Commercial, located at the end of Shady Hill Drive where it meets West Fork Goose Creek, legally described as Reserve "B", Rollingbrook, Section 4, Harris County, Texas.

c. Consider an ordinance authorizing a Special Use Permit for a proposed cell tower, 100 feet in height, on a tract of land approximately 0.13 acres of land being part of and out of 10.61 acres, zoned General Commercial, located at the end of Shady Hill Drive where it meets West Fork Goose Creek, legally described as Reserve "B", Rollingbrook, Section 4, Harris County, Texas.

5. PROPOSED ORDINANCES

a. Consider an ordinance authorizing a variance to Section 6-2 "Sales Near Schools, Churches, Hospitals, or Day Care Facilities," of the Code of Ordinances, City of Baytown, Texas, to allow a proposed sports bar and lounge to sell alcohol for on-premise consumption within 300 feet of a day care at the intersection of Park Street and Pruett Street, Baytown, Harris County, Texas.

b. Consider an ordinance awarding a construction contract to Angel Brothers Enterprises, LLC., for the Hunt Road East of Garth to N. Main St. and Hunt Road West from San Jacinto Blvd. to John Martin Road Project.

c. Consider an ordinance authorizing a Services Agreement with The University of Texas M.D. Anderson Cancer Center in furtherance of its Healthy Communities initiatives by bringing awareness to reduce Ultraviolet Radiation (UVR) to residents of the City.

6. CONSENT All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Council Member requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda.

a. Consider an ordinance voiding Pipeline Permit No. 18-02, which was granted in error to Lone Star Mont Belvieu LP, via Ordinance No. 13,738 on April 12, 2018, and granting pipeline permit to FLST LLC d/b/a Lavaca LST Pipeline LLC, for a 16-inch pipeline.

b. Consider an ordinance renewing the Annual Cement Stabilized Sand Contract with MegaSand Enterprises, Inc.

c. Consider a resolution authorizing the City of Baytown to apply to the Office of National Drug Control Policy for a 2018 grant for the Houston High Intensity Drug Trafficking Area Program.

d. Consider an ordinance amending Chapter 70 “Parks and Recreation” of the Code of Ordinances, Baytown, Texas, to permit driving, chipping, and putting in designated areas at Evergreen Park.

e. Consider an ordinance authorizing a Professional Services Agreement for the Houston High Intensity Drug Trafficking Area Program with MSM Resources Corporation.
