I JUST WANTED TO CLEAR UP SOME CONFUSION THAT HAPPENED WITH, UH, CCPD.
SO WHEN C, THIS BUDGET BEFORE YOU RIGHT NOW, CCPD RECEIVED THIS IN MAY.
UM, AND AS YOU CAN SEE, THE REVENUE WAS 2.5 MILLION.
THE EXPENDITURES WAS 2.7 AND THE FUND BALANCE WAS 17,000.
UM, WHEN THEY ADOPTED THE BUDGET, THEY RECEIVED A REVISED BUDGET, BUT DURING THAT MEETING, NO ONE MENTIONED THAT THE, THE AMOUNTS BETWEEN MAINTENANCE AND CAPITAL OUTLAY CHANGED.
BUT AS YOU CAN SEE, THE TOTAL REVENUE IS STILL THE SAME 2.5 MILLION AND THE EXPENDITURES IS 2.7, LEAVING A FUND BALANCE OF 17,000.
UM, SO I JUST WANTED TO MAKE SURE YOU ARE AWARE THAT THIS IS THE BUDGET THAT YOU'RE CONSIDERING WITH THIS HEARING TODAY, AND IT'S THE SAME ONE THAT THEY ADOPTED IN JULY.

AND SO I'M HERE TODAY TO ADDRESS SOME OF THOSE CONCERNS AND DISCUSS SOME OF THE ACTUAL, UM, POLICY CONSTRAINTS, THE LIMITATIONS REQUIREMENTS AND STANDARDS THAT CURRENTLY EXIST, UM, WITH SOME OF THE CHALLENGE CHALLENGES WE HAVE CONFRONTED WITH THESE UTILITY, UH, OUTAGES WE'VE EXPERIENCED.
SO JUST AS A QUICK OVERVIEW OF THE PRESENTATION, WE'LL DISCUSS AT THE LOCAL LEVEL WHAT OUR CURRENT CITY STANDARDS ARE.
WE'LL DISCUSS THE STATE AND FEDERAL REQUIREMENTS FOR THESE FACILITIES, AND WE'LL TALK ABOUT SOME OF THOSE, UH, LIMITING FACTORS WITHIN POLICY CONSTRAINTS.
AND THEN WE'LL TALK ABOUT THE STAFF RECOMMENDATIONS AND HOW WE CAN MOVE FORWARD TO IMPROVE OUR RESILIENCY WITHIN THIS AREA.
UM, MOVING FORWARD FOR OUR NEXT, UH, DISASTERS, JUST AS A QUICK OVERVIEW, I REALLY WANTED TO MAKE A CLEAR DISTINCTION BETWEEN THE DIFFERENT TYPES OF FACILITIES THAT WE'RE TALKING ABOUT BECAUSE THEY ARE REGULATED AND SOME OF THEM ARE COMPLETELY UNREGULATED FACILITIES.
UM, WE DO HAVE 17 LONG-TERM CARE FACILITIES THAT ARE CURRENTLY LICENSED BY THE STATE OF TEXAS, THE DEPARTMENT OF STATE HEALTH SERVICES.
AND WE HAVE THREE DIFFERENT TYPES OF MAIN LICENSING, UM, REQUIREMENTS.
AND BASICALLY THE MAIN DISTINCTION BETWEEN THESE THREE DIFFERENT TYPES IS THE LEVEL OF CARE THAT THEY'RE REQUIRED TO PROVIDE AS A HEALTHCARE ENTITY LICENSE UNDER THE STATE.
AND YOU CAN SEE A MAP HERE THAT DEPICTS THE DIFFERENT LOCATIONS ACROSS THE CITY OF BAYTOWN.
WE ALSO HAVE ANOTHER DISTINCTION IN TERMS OF THESE FACILITIES WHERE WE HAVE MULTI-FAMILY UNITS OR APARTMENT COMPLEXES THAT HOUSE SENIOR CITIZENS.
SO THE FAIR HOUSING ACT CLEARLY DEFINES WHAT HOUSING FOR OLDER PERSONS IS.
ONE THING I DO WANNA POINT OUT WITH THESE MULTI-FAMILY UNITS, THESE APARTMENT COMPLEXES, IS THAT THEY ACTUALLY DO NOT HAVE A SPECIAL OCCUPANCY CODE.
UM, AND THEY'RE CONSIDERED JUST LIKE ANY OTHER APARTMENT COMPLEX IN OUR UNREGULATED FACILITIES, UM, WE COMMONLY REFER TO THESE AS INDEPENDENT LIVING FACILITIES, SENIOR CITIZEN FACILITIES, SENIOR LIVING FACILITIES, RETIREMENT COMMUNITIES, BUT THEY'RE NOT LICENSED BY THE STATE OF TEXAS TO PROVIDE ANY CERTAIN LEVEL OF CARE AND AREN'T REQUIRED TO MEET, UM, ANY OF THE STATE REGULATIONS FOR LONG-TERM CARE PROVIDERS.
SO WHAT ARE OUR CURRENT CITY STANDARDS IN PLACE THAT ADDRESS THESE TYPE OF FACILITIES? UM, WE'RE VERY UNIQUE WITHIN THE CITY OF BAYTOWN IN THAT WE ACTUALLY HAVE A LOCAL MUNICIPAL ORDINANCE THAT ADDRESSES EMERGENCY MANAGEMENT PLANNING FOR LONG-TERM CARE FACILITIES.
IN FACT, WE'RE THE ONLY MUNICIPALITY WITHIN THE STATE OF TEXAS THAT ACTUALLY AT THE LOCAL LEVEL, OUR OFFICE OF EMERGENCY MANAGEMENT IS REQUIRED TO REVIEW THESE PLANS.
ACTUALLY IN 2023, WE PRESENTED BEFORE COUNCIL AN AMENDMENT TO OUR LOCAL ORDINANCE TO ACTUALLY MAKE SURE THAT OUR PLANNING REQUIREMENTS, UM, WERE ALIGNED TO THE STATE PLANNING REQUIREMENTS AND THEY HAVE EIGHT CORE FUNCTIONS.
SO WE REVIEW THESE PLANS ON AN ANNUAL BASIS WITH ALL OF THESE LICENSED CARE FACILITIES.
UM, IN ADDITION TO THAT, WE DO HAVE INSPECTION PROCESSES THAT ARE CURRENTLY IN PLACE WITHIN THE BUILDING DEPARTMENT AS WELL, OR THE BUILDING DIVISION AND THE FIRE MARSHALS, UM, DIVISION.
UM, SO OUR FIRE MARSHALS, THEY CONDUCT FIRE AND LIFE SAFETY INSPECTIONS FOR RESIDENTIAL CARE AND BOARD FACILITIES.
AND THEY DO THIS ON AN ANNUAL BASIS AND IT'S ACTUALLY REQUIRED FOR THEM TO GET A, UH, CERTIFICATE OF OCCUPANCY AS WELL AS THEIR STATE LICENSE.
UM, WE ALSO CONDUCT MULTI-FAMILY INSPECTIONS WITHIN OUR BUILDING INSPECTING DIVISION, UM, FOR ALL OF OUR APARTMENT COMPLEXES ON AN ANNUAL BASIS.
AND WE HAVE SUBJECT MATTER EXPERTS IN THE ROOM THAT CAN ANSWER ANY FURTHER QUESTIONS REGARDING THE INSPECTION PROCESS.

SO THOSE ARE THE LOCAL STANDARDS.UH, STATE AND FEDERAL STANDARDS ALSO IMPOSE DIFFERENT REQUIREMENTS AND I WANTED TO TOUCH BASE ON THOSE.
'CAUSE CURRENTLY UNDER STATE LAW, THE TEXAS ADMINISTRATIVE CODE, THE ONLY LICENSE FACILITIES THAT ARE REQUIRED TO HAVE ANY TYPE OF GENERATOR ATTACHED TO THEIR FACILITY ARE NURSING FACILITIES.
AND THEY, UH, REQUIRE A, UM, EMERGENCY POWER ONLY FOR CERTAIN AREAS OF THOSE FACILITIES, AND THEY ONLY HAVE TO POWER ESSENTIAL ELECTRICAL SYSTEMS. SO THIS MEANS THAT THEY'RE NOT EVEN REQUIRED TO PROVIDE THEIR ENTIRE HVA SYSTEM ON THAT EMERGENCY POWER.
UM, OTHER THAN THAT, THE OTHER LICENSED TYPE FACILITIES THAT ARE REGULATED BY THE STATE DO NOT HAVE A REQUIREMENT UNDER STATE CODE TO ACTUALLY HAVE GENERATORS.
UM, IF THEY DO HAVE GENERATORS THAT ARE INSTALLED AT THESE FACILITIES, THEY ARE THEN REQUIRED TO COMPLY WITH FIRE AND ELECTRICAL CODES WHEN THEY'RE INSTALLING THESE FACILITIES.
ONE OTHER DISTINCTION I WANTED TO CLEARLY MAKE AS WELL WITH THESE ASSISTED LIVING FACILITIES, THE LICENSED FACILITIES IS THERE HAVE BEEN TWO PAST LEGISLATIVE EFFORTS TO ADDRESS THIS PARTICULAR ISSUE, UM, BOTH IN THE 87TH LEGISLATIVE SESSION AND THE 88TH LEGISLATIVE SESSION.
BOTH CHAMBERS HAVE PRODUCED BILLS REQUIRING MANDATES THAT THESE, ALL OF THESE ASSISTED LIVING FACILITIES, INCLUDING NURSING FACILITIES, UM, ARE REQUIRED TO HAVE GENERATORS.
BOTH OF THOSE ATTEMPTS HAVE FAILED IN THE LAST TWO LEGISLATIVE SESSIONS, AND THERE'S A GREAT AMOUNT OF DISCUSSION CURRENTLY WITH HURRICANE BARREL AND THE NEXT LEGISLATIVE SESSION TO REPRESENT THESE, UM, UH, STATE STATUTE PROPOSALS.
FEDERAL REQUIREMENTS ARE EVEN LESS STRINGENT THAN OUR STATE REQUIREMENT.
IN FACT, UH, THE FEDERAL RULE, IF THEY DO RECEIVE MEDICAID AND MEDICARE SERVICES, THEY HAVE TO BE COMPLIANT WITH CONDITIONS OF PARTICIPATION.
THE ONLY REAL REQUIREMENT THEY HAVE IS TO ADDRESS THIS WITHIN THEIR RISK ASSESSMENT.
SO IF THEY SAY THEY HAVE POTENTIAL TO BE EXPOSED TO A POWER OUTAGE, THEN THEY'RE REQUIRED TO ADDRESS ALTERNATIVE POWER SOURCES.
HOWEVER, THE REQUIREMENT DOES NOT, UM, MANDATE A GENERATOR AT THESE FACILITIES.
SO MOST OF THESE FACILITIES CAN EASILY OPT OUT OF THIS SITUATION BY SAYING THEY HAVE AN EVACUATION AND RELOCATION PLAN IN PLACE, AND THEY ARE NOT REQUIRED UNDER FEDERAL, UM, STANDARDS RIGHT NOW TO HAVE ANY GENERATOR AT ANY OF THESE TYPES OF LICENSED FACILITIES.
AND ONE THING I DO WANNA STRESS AS WELL IS THE APARTMENT COMPLEXES THAT ARE UNREGULATED DO NOT COMPLY WITH ANY OF THESE, UM, ACTUAL REQUIREMENTS.
SO WHAT ARE SOME OF THE OTHER LIMITATIONS WE'RE CONFRONTED WITH WHEN TRYING TO ADDRESS THIS ISSUE? WE DID HAVE, UM, A LOT OF DISCUSSION, UM, AMONGST THE STAFF MEMBERS, UM, ABOUT A PROPOSAL POTENTIALLY, UM, TO TRY TO ADDRESS THIS ISSUE.
AND THE BIGGEST HURDLE THAT WE HAVE CONFRONTED WITH US AT THE MUNICIPAL LEVEL IS A STATE LAW THAT PASSED THE LAST LEGISLATIVE SESSION, COMMONLY REFERRED TO AS THE DEATH STAR, UH, LAW, SIMPLY THAT WE'RE PREEMPTED FROM ACTUALLY TAKING ANY ACTION THAT WOULD IMPOSE A HIGHER STANDARD OR MORE STRINGENT STANDARD ON THESE REGULATED FACILITIES AT THE STATE LEVEL.
SO THE TEXAS REGULATORY ACT, UM, PRESENTS A VERY, UM, CHALLENGING LEGAL CONSIDERATION FOR US.
IN ADDITION TO THAT, THE HOUSING OF OF OLDER PERSONS, SO THE MULTI-FAMILY UNITS, WE ALSO HAVE GREAT CONCERN WITH, UM, MANDATING THESE GENERATORS WOULD PRESENT CHALLENGES IN TERMS OF PROPERTY RIGHTS AS WELL AS TAKING CLAUSE CHALLENGES.
AND NOT TO MENTION THE FACT THAT THERE'S BEEN SEVERAL LEGAL CHALLENGES BY THE TRADE ASSOCIATIONS WHENEVER THIS HAS BEEN BROUGHT UP AT THE STATE LEVEL.
SO THIS WOULD CREATE UNDUE HARDSHIPS FOR FUTURE DEVELOPMENT, ESPECIALLY WITHIN THIS PARTICULAR AREA.
UM, PROBABLY THE MOST RELEVANT CHALLENGE FOR US THOUGH AT A MUNICIPAL LEVEL IS THE ENFORCEMENT ASPECT OF THIS BILL.
IT WOULD BE VERY DIFFICULT FOR US TO DO THIS AND WOULD ACTUALLY REQUIRE ADDITIONAL PERSONNEL FOR US, UM, BOTH WITHIN THE PLANNING DEPARTMENT AND THE FIRE MARSHAL'S OFFICE.
UM, WE'RE ESTIMATING ANYWHERE FROM TWO TO THREE ADDITIONAL PERSONNEL TO IMPLEMENT THIS AND THEN TO MAKE SURE THAT ALL OF THE MAINTENANCE REQUIREMENTS REQUIRED UNDER CODE, UM, WOULD BE IMPLEMENTED IN TERMS OF THE FIRE AND, UH, ELECTRICAL CODES.
SO WHAT ARE OUR RECOMMENDATIONS? WHAT CAN WE DO UNDERSTANDING THESE LIMITATIONS? UM, AT THIS TIME, WE ARE NOT RECOMMENDING A LOCAL ORDINANCE THAT WOULD MANDATE GENERATORS AT ANY OF THESE LICENSE FACILITIES OR AT THE HOUSING FOR OLDER PERSONS.
THESE APARTMENT COMPLEXES REALLY A FUTURE STATE IN THIS IS GONNA REQUIRE LEGISLATIVE CHANGE AT THE STATE LEVEL AND HOPEFULLY IN THIS NEXT LEGISLATIVE SESSION, THE STATE WILL PASS SOMETHING TO ADDRESS THESE ISSUES.
SO WHAT CAN WE DO AS A CITY IN TERMS OF HELPING IMPROVE OUR RESILIENCY? AND WE HAVE A LIST OF DIFFERENT, UH, PROPOSALS HERE THAT WE CAN TAKE CURRENTLY, UM, WITHIN THE FIRE DEPARTMENT, UM, WITHIN OUR PLANNING DEPARTMENT AND ESPECIALLY WITHIN OUR PUBLIC AFFAIRS.
IN TERMS OF COMMUNITY OUTREACH TO THESE FACILITIES, UH, THE FIRST PROPOSAL WE HAVE LISTED HERE IS TO DEVELOP A CONTACT LIST.
WE MAINTAIN A LIST OF ALL OUR LICENSE FACILITIES, BUT THIS WOULD IMPROVE OUR LISTING OF INDIVIDUALS THAT ARE LIVING IN THESE MULTI-FAMILY UNIT COMPLEXES THAT ARE UNREGULATED AND MAKE SURE WE HAVE GOOD CONTACT INFORMATION FOR, UH, THE PROPERTY OWNER AND MANAGEMENT

COMPANY SO WE CAN COMMUNICATE TO THEM BEFORE, DURING, AND AFTER A DISASTER.UM, WE WOULD MAKE A MORE CONCERTED EFFORT THIS GO AROUND IN OUR ANNUAL VIEW TO MAKE SURE THAT THE RISK ASSESSMENTS THESE FACILITIES THAT ARE LICENSED AND REQUIRED TO ADDRESS POWER OUTAGES IS IN THEIR PLAN AND TO MAKE SURE THAT THEY'RE ADDRESSING ALTERNATIVE POWER SOURCES.
SO WE DO THIS ALREADY ON ANNUAL BASIS, BUT WE WOULD DO A DEEP DIVE INTO THIS TO MAKE SURE THAT THEY'RE ADDRESSING THIS MORE THOROUGHLY.
AND THEN THE OTHER ITEMS THAT WE HAVE HERE ON THE PRESENTATION INVOLVE A MULTITUDE OF DIFFERENT PUBLIC EDUCATION STRATEGIES IN TERMS OF, UH, EVACUATION PLANS, MAKING SURE THESE MULTI-STORY BUILDINGS WITH PEOPLE WITH INDIVIDUAL NEEDS AND DISABILITIES KNOW THEIR EVACUATION PLAN AND HOW THEY CAN BE RESCUED OUT.
AND A LOT OF THIS WOULD INVOLVE OUTREACH, UM, AND MAKING SURE THEY'RE ON OUR BAYTOWN ALERT SYSTEM AND THE STATE, UH, EMERGENCY ASSISTANCE REGISTRY AS WELL FOR MEDICALLY FRAGILE.
AND LAST BUT NOT LEAST, MAKING SURE THAT THEY'RE REGISTERED WITH CENTER POINTS, CHRONIC CONDITION AND CRITICAL CARE CUSTOMER STATUS.
IT WILL NOT GUARANTEE THAT THESE INDIVIDUALS WILL BE, UH, PRIORITIZED IN TERMS OF RESTORATION, BUT IT GIVES THE UTILITY AT LEAST AN UNDERSTANDING OF WHERE OUR MOST VULNERABLE POPULATIONS ARE WITHIN BAYTOWN.
SO WE WANT TO PRESENT YOU THESE OPTIONS AND SOME DISCUSSION KNOWING THAT COUNCIL HAS HAD SOME CONCERNS WITH THIS AND WE'RE OPEN TO ANY QUESTIONS YOU MAY HAVE.
UM, WHAT I, WHAT I WANTED TO START OFF WITH IS I DO APPRECIATE ALL THE INFORMATION AND UH, IT'S GOOD TO SEE THAT THAT WE, UM, I KNEW THAT WE HAD A LIST OF THE, THE FACILITIES.
UM, WE ALWAYS HAVE ASKED THEM TO, TO HAVE A PLAN IN PLACE, OBVIOUSLY WHEN THERE'S A, A STORM APPROACHING, UM, IF IT'S EVACUATION OR WHATEVER THE CASE MAY BE.
UM, WHAT WAS PARTICULARLY TROUBLING TO ME, I WAS WITH COUNCILMAN, UH, ARO, COUNCILWOMAN RADO AT THE TIME AT A, I GUESS IT'S, UM, I'M JUST GONNA SAY WAS MAYBE JUST CONSIDERED AN APARTMENT COMPLEX REALLY, BUT THE NON-REGULATED 55 AND OLDER COMMUNITY AND, AND THAT'S WHERE WAS, WAS DIFFICULT PARTICULARLY IS THAT, UM, I THINK TRYING TO ARRANGE, I GUESS TRANSPORT FROM THAT FACILITY TO, I GUESS THE COUNTY WAS GONNA PROVIDE BASICALLY AN ACTUAL LIVING, TEMPORARY LIVING SHELTER IN A SENSE.
UH, BUT UNFORTUNATELY THE ELEVATOR, AND THIS WAS, I'M GONNA SAY IT'S AT LEAST, AT LEAST AN EIGHT STORY BUILDING SOMEWHERE IN THAT RANGE.
SO MY CONCERN WOULD BE IF THERE WOULD'VE BEEN ANY TYPE OF EMS CALL ON THE SECOND STORY ABOVE, MOST OF THESE INDIVIDUALS ARE AGED AND THEY CANNOT MOVE, UH, EASILY.
AND SO IT WAS, UH, BESIDES THE HEAT, UM, ANY, ANY EMERGENCY WOULD BE EXTREMELY HARD FOR OUR FOLKS TO GET TO THEM OR FOR THEM TO GET HELP.
UM, AND THAT WAS, THAT WAS REALLY, REALLY CONCERNING.
SO, UM, I, I TOTALLY UNDERSTAND.
UM, I THINK THERE WAS SOME BULLETS IN THERE.
YOU TALKED ABOUT IT AS FAR AS, YOU KNOW, LIKE I SHOULD SAY AT A LOCAL LEVEL AND CERTAIN OF, EVEN AT A STATE LEVEL, UM, IT'S PROBABLY FAILED BECAUSE OF JUST SAY WHEN, WHEN, HOW MUCH GOVERNMENT SHOULD HAVE SAY IN, IN A SENSE, UH, IN SOME FACILITIES.
BUT WE ARE TALKING, IN SOME CASES WE ARE TALKING ABOUT SOME LIFE SAFETY ISSUES THAT, THAT CAME VERY APPARENT, UM, JUST THIS LAST STORM WITH THE WIDESPREAD, UH, POWER OUTAGE AND PARTICULARLY FOR EMERGENCY SERVICES, IT MAKES IT TRULY EXTREMELY DIFFICULT FOR US.
UM, I'M NOT SURE THIS IS GONNA BE THE END OF THE COUNCIL DISCUSSION, BUT CERTAINLY WE KNOW THAT ATTEMPTS HAVE BEEN MADE AT A STATE LEVEL, WHICH I BELIEVE IS THE APPROPRIATE, I GUESS, LEVEL OF GOVERNMENT TO ADDRESS THAT BECAUSE THEY'RE REGULATED, THEY'RE, THEY'RE PART OF THE, THE REGULATED, UH, AGENCIES, UM, ANYWAY, UM, BUT WE DO NEED TO MAKE SURE THAT, UM, I THINK WHAT WE USED TO DO IN PREVIOUS STORMS WAS THESE EVACUATIONS TAKE PLACE THAT THEY HAVE TRANSPORT AND PRE AND PRE-ARRANGE PLANS.
AND I DIDN'T REALLY SEE A LOT OF THAT IN THIS, UM, IN THIS PAST STORM.

OTHERS DO NOT HAVE ANYBODY ELSE.
AND SO WE AS, AS LEADERS AND OTHER COMMUNITY MEMBERS SHOULD BE WORRIED ABOUT THAT.
THE FACT THAT THESE CITIZENS REALLY HAVE NO VOICE, UH, BECAUSE THIS HAPPENED, THIS HAS HAPPENED BEFORE IN THIS PARTICULAR BUILDING, EVEN BEFORE, EVEN WITHOUT A STORM.
WE LOSE POWER, YOU KNOW, JUST ANY OTHER DAY, SOMETIMES FIVE DAYS IN A ROW.
AND, UM, WHEN THEY HAVE MEDICAL EMERGENCIES OR JUST AN EMERGENCY AT ALL, I, BECAUSE THEY DON'T HAVE STAFF MM-HMM
THAT'S THERE OTHER THAN A MAINTENANCE PERSON THAT REAL HAS NO REAL AUTHORITY, I'M LIKE, WHAT DO Y'ALL DO? WE CALL 9 1 1.
SO THAT'S ANOTHER BURDEN, RIGHT? UM, EVEN IF IT'S TRYING TO GET DOWN THE STAIRS OR WHATEVER.

UM, MY EXPERIENCE AND ISSUES WITH THE, THE UNREGULATED 55 AND OLDER COMMUNITIES STARTED LONG BEFORE COUNCIL.
'CAUSE I HAVE, UH, FAMILY MEMBERS THAT LIVE IN THESE COMMUNITIES AND, UM, I'M GONNA PIGGYBACK ON A LOT OF WHAT THEY SAID, BUT ONE OF THE THINGS THAT I THOUGHT ABOUT, UM, I UNDERSTAND THAT, YOU KNOW, WHEN WE'RE TALKING ABOUT PRIVATE PROPERTY, PROPERTY OWNER RIGHTS THAT ARE ALSO EXTREMELY IMPORTANT, UM, I WOULD HOPE WE ALL AGREE THAT LIFE ITSELF TRUMPS PROPERTY RIGHTS.
BUT WITH ALL OF THAT BEING SAID, UM, I'M WONDERING IF WE AS A CITY CAN DO AN ORDINANCE WHERE WE REQUIRE SIGNAGE ON 55 AND OLDER COMMUNITIES.
UM, IF YOU ARE, IF YOU'RE GONNA OPERATE THIS AS A 55 AND OLDER COMMUNITY IN THE CITY OF BAYTOWN, SOME TYPE OF SIGNAGE THAT SAYS IS, UM, MAKING THE RESIDENTS AND THE PEOPLE THERE AWARE THAT THERE ARE NOT REGULATIONS, THERE ARE NOT GENERATORS AVAILABLE, THINGS LIKE THAT.
UM, BECAUSE A, A LOT OF FAMILIES WHEN, OR INDIVIDUALS THAT MOVE INTO THESE FACILITIES, THEY'RE NOT THINKING ABOUT THE EMERGENCY SITUATION OF BARREL AND WHAT'S GONNA HAPPEN.
UM, ALSO TO TALK ABOUT THE ELEVATOR SITUATION, UM, ONE OF MY FIRST DISCUSSIONS ON COUNCIL, WE WERE TALKING ABOUT THE MULTIFAMILY FACILITY THAT WAS NOT 55 AND OLDER AND THEY WERE WANTING TO BE THREE OR FOUR STORIES AND I MADE SOME COMMENTS, UM, AND THE PERSON PRESENTING, YOU KNOW, IT WAS KIND OF SCOFFED AT A LITTLE BIT, BUT THE REASON I'M VERY PASSIONATE ABOUT NOT HAVING THREE STORY BUILDINGS SPECIFICALLY FOR 55 AND OLDER IS BECAUSE THERE ARE TWO THAT I KNOW OF IN BAYTOWN, ONE OF THEM SPECIFICALLY HAS HAD AN ELEVATOR GO OUT IN THE BUILDING FOR OVER 20 DAYS.
AND UM, THAT BUILDING ONLY HAS ONE ELEVATOR.
AND, UM, THE FIRE DEPARTMENT IS VERY WELL ACQUAINTED WITH MOST OF THE PEOPLE AT THIS FACILITY BECAUSE, UM, YOU KNOW, THEY MIGHT MOVE IN WHEN THEY'RE 55 AND STAY THERE 15 YEARS AND MOBILITY CHANGES, RIGHT? UM, THINGS CHANGE.
AND SO THE FACILITY OFFERS TO LET THEM MOVE DOWN IF AN APARTMENT BECOMES AVAILABLE, BUT THAT'S NOT EVEN INCLUDING WHEN YOU HAVE AN EMERGENCY SITUATION.
RIGHT? UM, SO I JUST THINK AS A COUNCIL WE NEED TO BE COGNIZANT OF WHEN WE'RE APPROVING BUILDINGS, MAYBE THIS COULD EVEN GO, THIS COULD, UM, FLOOD OVER INTO PLANNING AND ZONING AND, AND THINGS LIKE THAT.
WE MAYBE SHOULDN'T ALLOW BUILDINGS WITH ONLY ONE ELEVATOR IN THEM.
UM, AND MAYBE SOME TYPE OF SIGNAGE.
I DUNNO, THOSE ARE THE ONLY TWO IDEAS I CAN PULL OUT OF MY HAT RIGHT NOW.
AND I DON'T EVEN KNOW IF, IF THAT'S LEGAL, BUT I DO APPRECIATE ALL YOUR RESEARCH.

UM, SO WE HAVE LOTS OF BUSINESSES THAT ARE, LEMME NOT USE LOTS.
THERE ARE QUITE A FEW BUSINESSES THAT ARE WITHIN 200 FEET ON MAIN STREET OF RESIDENTIAL AREAS.
UM, THAT HAVE SPEAKERS AND OTHER THINGS, UM, DRIVE THROUGHS THAT THEY USE FOR THEIR BUSINESS.
I'M GONNA SHARE THIS STORY OF HER BUSINESS.

UM, THERE ARE SOME RESIDENTS THAT, UM, WHOSE PROPERTY BORDER HER BUSINESS THAT ARE UPSET BECAUSE THEY HEAR LOUD, UM, SPEAKER MUSIC, THE POLICE, ACCORDING TO THIS BUSINESS OWNER, HAVE BEEN CALLED OUT NUMEROUS TIMES AND SHE'S TRIED TO MEDIATE AND WORK WITH, UM, THE RESIDENTS TELL, AND HERE, HERE'S THE OTHER HARD LINE WITH THIS.
MOST OF THE TIME IT'S NOT HER BUSINESS THAT HAS THE NOISE, IT'S THE CUSTOMERS.
UM, AND SO BY THE TIME THE POLICE COME OUT, THE CUSTOMER WHO HAD LOUD MUSIC IN THEIR VEHICLE IS GONE AND POLICE HAVE HAD TO, UH, RESPOND TO THE CALLS A LOT.
SO HER PROPOSAL WAS TO ASK COUNSEL TO CONSIDER AFTER DISCUSSION, UM, POSSIBLY MOVING THE, UM, SOUND ORDINANCE FROM 10:00 PM TO 11:00 PM AND THESE WERE HER REASONS WHY, UM, SHE, AND SHE ONLY WANTS IT FOR, SHE THINKS THAT IT WILL BENEFIT OUR COMMUNITY TO DO THIS AS A WHOLE ON FRIDAY AND SATURDAY EVENINGS ONLY.
IT'S ONLY EXTENDING IT FROM AN HOUR FROM 10 TO 11:00 PM AND THEN SHE ALSO THOUGHT THAT IT WOULD BE A GOOD IDEA TO, UM, TO EXTEND IT ON HOLIDAYS FOR ONE HOUR.
SHE REALLY JUST THINKS THAT IT'S GONNA, UM, LESSEN THE BURDEN ON THE POLICE COMING OUT BECAUSE THERE'S NOT A LOT THAT THEY CAN DO.

UH, THIS AGREEMENT HAS ENABLED US TO EFFECTIVELY LEVERAGE THE SPORTS CORPS'S EXPERTISE AND RESOURCES DURING THESE PRELIMINARY STAGES.
ADDITIONALLY, AN AMENDMENT, UH, TO THE ILA WILL BE PRESENTED FOR YOUR CONSIDERATION, UH, REGARDING THE OWNER'S REPRESENTATIVE SERVICES AND PROJECT MANAGEMENT SERVICES AT A FUTURE COUNCIL MEETING.
UH, IN THE MEANTIME, I WOULD LIKE TO INTRODUCE, UH, MR. RYAN WALSH.

CERTAINLY PART OF OUR THOUGHT PROCESS AS WE'RE GOING THROUGH THE PLANNING PHASES, SPORTS, OBVIOUSLY, WHETHER IT'S, UH, COLLEGIATE OR HIGH SCHOOL OR EVEN YOUNGER, UH, IT'S AN IMPORTANT PART OF THE EDUCATION AND RECREATION PROCESS AS WELL, IS TO KEEP KIDS ACTIVE.
AND THAT'S ONE OF OUR FOCUSES AS WELL, FOCUSING ON THE YOUTH SPORTS, UH, HOPEFULLY MAKING IT A HUB.

UH, IT'S ABOUT 120,000 SQUARE FEET.
HAS A LOT OF THOSE SAME AMENITIES, HAS A GREAT USE OF TECHNOLOGY THAT INCORPORATES NOT JUST FOR THE SPORTS SIDE, BUT ALSO THE COMMUNITY SIDE.
THEY HAVE AN ESPORTS FACILITY, THEY HAVE A LEARNING LAB, THEY HAVE SOCCER FIELDS, THEY HAVE OUTDOOR, UH, WATER FEATURES.
IT'S A REALLY, REALLY NEAT BUILDING THAT'S GOING TO BE PART OF A LARGER, UH, COMPLEX THAT THEY'RE BUILDING OUT IN BRYAN.
AND THEN HENRICO COUNTY EVENTS CENTER IN, UM, UH, NORTH CAROLINA IS ALSO A GREAT EXAMPLE OF A CREATIVE USE OF THESE TYPES OF FACILITIES.
AND THIS ONE TO NOTE IS, UH, OPERATED BY A SM GLOBAL AS WELL.
IT'S GOT ABOUT 185,000 SQUARE FEET.
UM, SAME, UH, A LOT OF THESE FACILITIES HAVE A COMPARABLE AMENITIES, UH, THAT DIFFER BASED ON THE LOCATION.

ON THE THIRD DAY, I SAW A CREW IN THE NEIGHBORHOOD AND ASKED THEM IF WE, IF THEY WERE AWARE, JUST A QUICK SIDE NOTE, LAKEWOOD, SOMEBODY'S REPORTING THAT WE WERE THERE AT THE THIRD DAY JUST FOR LAKEWOOD
UM, THEY, UH, THEY, UH, ON THE THIRD DAY I SAW A CREW IN THE NEIGHBORHOOD.

IT'S BEEN SO MUCH THAT OUR DEBRIS CONTRACTOR WAS ACTIVATED.
UM, SO WE HAVE OUR DEBRIS CONTRACTOR WORKING, WHICH IS A FEDERAL, UH, A FEDERAL, UH, GUIDELINES FOR THAT DEBRIS CONTRACTOR TO HELP US WITH, WITH RESPONSE LIKE THIS.
AND THEN WE HAVE OUR BRUSH PICKUP TEAM.
SO ALL THE ASSETS THAT WE HAVE ARE DEPLOYED AT THIS TIME, ALONG WITH A LARGE CONTRACTOR THAT IS HELPING PICK UP THIS DEBRIS.
WHEN THE DEBRIS CONTRACTOR FIRST STARTED, THEY DROVE AROUND AND DID AN ESTIMATE OF THE TOTAL COST OR THE TOTAL AMOUNT OF, UH, DEBRIS THAT THEY SEE ON THE GROUND AND GAVE A COST OF WHAT THAT WOULD LOOK LIKE.
UH, AND IT STARTED AT 600,000 AS THINGS CONTINUED TO BE PICKED UP.
THAT CHANGE ORDER CAME IN AND IT GREW.
AS IT CONTINUED, PEOPLE CONTINUED TO BRING MORE STUFF OUT.
THE MAXIMUM OUR CONTRACT CAN BE IS 1.5 MILLION.
WE ARE ABOUT TO SURPASS THE 1.5 MILLION A DOLLAR MARK AT THIS POINT.
WE WILL SURPASS THE 1.5 MILLION WITHOUT COMPLETING THE FIRST PASS.
UH, THROUGH ALL OF THE ZONES, THERE IS THAT MUCH DEBRIS ON THE GROUND RIGHT NOW.
WE ARE GONNA BRING TO THE, TO THE, UH, WE'RE GONNA DO ONE MORE CHANGE ORDER.
UM, WE ARE CAN LEGALLY ONLY GO 25% OVER THE FINAL AMOUNT OF 1.5.
IF THE CITY WANTS TO GET REIMBURSED, THAT'S THE MAX THAT WE CAN GO OVER.
THERE IS THAT MUCH DEBRIS ON THE GROUND.
WE UNDERSTAND THAT IT'S TAKING A LONG TIME.
WE HAVE EVERYTHING OUT THERE THAT WE CAN GET OUT THERE.
UM, UNLESS WE WANT TO DISH, DISH OUT ANOTHER PROBABLY $2 MILLION WITHOUT GETTING, GETTING REIMBURSED FROM THE FEDERAL GOVERNMENT, UH, THOSE ARE THE OPTIONS THAT ARE IN FRONT OF US.
NOT MAKING EXCUSES, JUST TRYING TO GIVE EVERYBODY AN UNDERSTANDING OF WHAT'S HAPPENING OUT ON THE STREETS RIGHT NOW.
WE ARE LOOKING AT A EMERGENCY ORDERS THAT WE CAN GET ANOTHER CONTRACT IN PLACE AND DIFFERENT, UH, ALTERNATIVES SO THAT WE DON'T HAVE A PAUSE AND SERVICE AT THIS POINT.
BUT I DO WANNA PUT IT OUT THERE ON THE, UH, THE AMOUNT OF DEBRIS THAT IS ACTUALLY BEING PICKED UP RIGHT NOW.
CAN, CAN I ADD AND KIND OF A QUESTION TOO, BUT MY UNDERSTANDING AT LEAST.
SO IT IS NOT JUST THAT, YOU KNOW, LIKE THE CONTRACTOR SAID, THIS IS OUR, THIS IS, UM, WHAT WE WOULD CHARGE.
IT'S BECAUSE IT'S, IT'S A FEDERAL REIMBURSEMENT'S, RIGHT? THEY GET PAID, I THINK THE SAME AMOUNT PER IT'S ALL MEASURED.
IT IS PER WHATEVER CUBIC VOLUME.
SO AT THE END OF THE DAY, THE PRICE IS THE PRICE.
SO IT'S JUST THE AMOUNT OF VOLUME THAT, THAT IT AS PEOPLE, I MEAN WE HAD SOME, SOME FOLKS INFECTED THERE SOMEWHERE IN THE ROOM WHERE THEY PUT OUT THEIR FIRST PASS OF, OF WHAT THEY COULD BRING TO, IN A SENSE, TO THE, THE FRONT YARD OR WHATEVER.

SO THE 1.5 MILLION IS NOT BECAUSE THAT'S WHAT THE CONTRACTOR CHARGE.
IT'S BECAUSE THAT'S WHAT THE, THE FEDERAL GOVERNMENT IS ALLOWING FOR, FOR IT BY VOLUME.
AND ANECDOTALLY, UM, OUR CONTRACTORS ARE TELLING US THEY HAVE NEVER SEEN THIS MUCH DEBRIS WITH A CAT ONE STORM.
UM, THAT TYPICALLY WHAT WE'RE SEEING IS THE RESPONSE THAT THEY SEE WITH CAT THREE STORMS. AND THIS IS STILL SOMETIMES SURPASSING WHAT THAT, AND SO THERE IS A LOT OF DEBRIS OUT THERE.
PLEASE, UM, PLEASE PACK YOUR PATIENTS.
PLEASE UNDERSTAND WITH GRACE, PLEASE KNOW THAT WE HAVE EVERYBODY OUT THERE THAT WE, THAT WE CAN TRYING TO RESPOND TO THIS AS QUICKLY AS POSSIBLE.
WE KNOW THE INCONVENIENCE AND WE HATE IT FOR, FOR THE PEOPLE THAT IT IS CREATING A HARDSHIP.

LIFE IS IN THE BID FOR, FOR THE, UH, IT WAS IN THE BID PHASE.
BIDS ARE DUE THIS MONTH AND CONSTRUCTION IS RESCHEDULED TO BEGIN IN NOVEMBER.
GARTH ROAD, THE CONSTRUCTION PROJECT TO RELOCATE UTILITIES ALONG, UH, SECTIONS A AND B IS SCHEDULED FOR COMPLETION IN EARLY 2025.
DESIGN A, C, D, AND E IS 60% COMPLETE.
ROADWAY CONSTRUCTION OF PHASE A AND B IS SCHEDULED TO BEGIN IN MID 2025.
LANDON PARK, UH, ATLANTA PARK STREET AND DRAINAGE INFRASTRUCTURE REPLACEMENT.
THIS PROJECT IS, IS IN THE DESIGN PHASE AND IS APPROXIMATELY 60% COMPLETE.
PUBLIC WORKS STAFF AND THE CONSULTING ENGINEER ARE WORKING WITH THE COUNTY TO DETERMINE DRAINAGE REQUIREMENTS.
UH, I 10 LIST STATION IMPROVEMENTS.
THIS DESIGN IS APPROXIMATELY 90% COMPLETE.
STAFF IS WORKING ON, UH, ROW ACQUISITION FOR THE PROJECT, UH, SCADA UPGRADES FOR WASTEWATER TREATMENT PLANTS AND LIST STATIONS.
BIDS FOR CONSTRUCTION SERVICES WERE RECEIVED FOR THE FIRST PHASE OF THIS A RPA FUNDED PROJECT AND ARE BEING EVALUATED.
THE FIRST PHASE CALLS FOR INSTALLATION OF NEW EQUIPMENT AT ALL BAY TOWN LIST STATIONS.
THE SECOND PHASE IS IN DESIGN AND APPROXIMATELY 80% COMPLETE.
A CONSTRUCTION CONTRACT FOR THIS WORK WILL BE PRESENTED TO CITY COUNCIL IN NOVEMBER OF NOVEMBER OR DECEMBER.
UM, PLANNING AND DEVELOPMENT AT, UH, 46 0 1 VILLAGE LANE, UPDATING APARTMENT UNITS AND INCREASING THE NUMBER OF, OF ACCESSIBLE UNITS.
UM, PERMIT ISSUED, UH, NO INSPECTIONS HAVE BEEN MADE YET ON THOSE APARTMENTS.
UH, I 10 EAST BUCKY'S KITCHEN REMODELED AN ELECTRIC, UH, VEHICLE CHARGING, CAR WASHING.
UH, COMPLETE KITCHEN IS REMODELED.
UH, JUST STARTED AN ELECTRIC CHARGE AND PLAN REVIEW.
SO THE KITCHEN'S REMODELED AND THE ELECTRIC CHARGING STATION IS COMPLETE.
UH, 73 0 3 GUARDS, WHITE WATCH, WHITE WATER CAR WASH, 40% COMPLETE UNDER THE UNDER INSPECT AND IS UNDER INSPECTION.

THEY'VE BEEN AWAY FROM THEIR FAMILIES FOR WEEKS AND WEEKS AND, AND WE'LL BE AWAY FROM FOR MORE WEEKS.
I KNOW WE HEARD, HEARD A LOT OF HORROR STORIES ABOUT SOME OF THE MISTREATMENT, BUT THOSE GUYS DID PHENOMENAL WORK REGARDLESS OF THE MANAGEMENT ISSUES.
THEY DID PHENOMENAL WORK AND, AND FOR THE MOST PART, THEY INDICATED OUR CITIZENS WERE VERY FRIENDLY, VERY SUPPORTIVE, AND SO KUDOS TO OUR CITIZENS FOR UNDERSTANDING THAT, THAT THOSE GUYS ARE JUST DOING THE WORK, THE HARD WORK AND, AND VERY APPRECIATIVE OF IT.
