WE WILL BE LED IN OUR PLEDGE AND INVOCATION THIS EVENING BY COUNCIL MEMBER JAMES FRANCO OF DISTRICT NUMBER FOUR, PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA, AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD AND INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL TEXAS FLAG.

THIS IS MY, I'M GONNA ADDRESS SOME IN THE PAST.

IT SAYS, I AND MANY OF OTHER RESIDENTS ADDRESS THE CITY COUNCIL FOR THE FIRST TIME IN SEPTEMBER, 2017.

AGAIN IN OCTOBER AND NOVEMBER, ASKING NOT TO BE ANNEXED.

ALL OF THESE PLEAS FELL UPON DEAF EARS.

THREE MONTHS LATER, FIVE DIFFERENT AREAS WERE ANNEXED, MINE INCLUDED AGAINST RESIDENT WISHES.

I READ A STATEMENT FROM THE BAYTOWN SUN DATED NOVEMBER 27TH, 2017 FROM THE MAYOR, THEN STEPHEN DECARLO STATING THAT A NEW STATE LAW WILL GO IN EFFECT CONCERNING ANNEXATIONS SENATE BILL SIX REQUIRING CITIZENS VOTE FOR APPROVAL ON ANNEXATION.

HE STATED THE LAW WAS CHANGING AND THEY NEEDED TO DO 30 YEARS OF PLANNING IN A VERY SHORT TIME.

DID THE, DID, DID THE CITY EVEN HAVE THE FUNDS TO BACK UP THESE 30 YEARS? MUCH LESS THE ANNEXATIONS GIVEN US FULL SERVICES.

SO FAR WE'VE RECEIVED NONE AND IT'S SIX AND A HALF YEARS SINCE.

IN MY OPINION, THIS WAS NO BETTER THAN LYING, CHEATING AND STEALING THE WAY WE WERE ANNEXED WAS WRONG ON SO MANY LEVELS.

I AM ADDRESSING THE COUNCIL FOR THE THIRD TIME THIS YEAR ASKING TO BE D ANNEXED.

THIS COUNCIL HAS THE RIGHT TO, TO MAKE

AND SINCE BEING ANNEXED, WHY ARE SOME PEOPLE THAT ARE, WERE ANNEXED AT THE SAME TIME NOT PAYING CITY TAXES.

I'M REFERRING TO A, UH, ACCOUNT NUMBER 0 5 9 1 5 0 0 2 0 0 1 8 8.

THEY HAVE NOT PAID ONE PENNY OF CITY TAXES SINCE WE WERE ANNEXED AND THEY ARE AND WAS INCLUDED IN THAT ANNEXATION.

WE WILL BE HERE EVERY TIME YOU HAVE A CITY COUNCIL MEETING BECAUSE WE WANT THIS RECTIFIED.

WE DON'T WANT TO BE IN THE CITY.

I BROUGHT UP THE COST OF WHAT IT WOULD TAKE FOR ME TO TIE IN.

AT THAT TIME IT WAS APPROXIMATELY $50,000 FOR RUNNING WATER AND SEWER.

THE $5,200 TIE IN METER.

AND NOW I GOT ESTIMATES FROM A PLUMBING COMPANY FOR THESE.

I HAVEN'T GOTTEN A RECENT ONE, BUT I WOULD IMAGINE THEY'VE GONE UP JUST LIKE EVERYTHING ELSE TO BE CLOSER TO 80 OR $90,000.

I DON'T SEE HOW IT WOULD BE RIGHT FOR THAT COST TO BE BURDENED TO ME WHEN THERE'S NOT EVEN LINES UP THERE.

I'M TRYING TO, WE'RE FAR EVERYONE FROM CEDAR BY LYNCHBURG TO BLUE HERON IS FAR ENOUGH OFF THE ROAD THAT THE ORDINANCE WOULDN'T MAKE US TIE IN.

WE'RE FURTHER THAN A HUNDRED FEET OFF THE ROAD.

SO SAVE THE CITY SOME MONEY, DON'T PUT IT IN THERE.

SAVE ME MONEY BECAUSE I WILL NEVER GET THAT MONEY BACK.

I HAVE NO RES WELL, I HAD ONE RESPONSE TODAY AND I SET UP A MEETING FOR TUESDAY AT 2:00 PM IN THEIR OFFICE FOR THE PERMITS TO SEE WHY THEY DENIED ME.

I WOULD LIKE A RECALL BACK FROM CITY COUNCIL FOR ME TO FIGURE OUT WHAT'S MY NEXT STEP IF THEY DON'T GIVE HIM MY PERMITS.

WE'RE GONNA RECOGNIZE THE CITY OF BAYTOWN EMPLOYEES FOR THE YEARS OF SERVICE.

MR. LOPEZ.

GOOD EVENING MAYOR AND COUNSEL.

AND WE HAVE ONE EMPLOYEE TO RECOGNIZE FROM OUR BAYTOWN POLICE DEPARTMENT, STEVE DORIS.

25 YEARS OF SERVICE.

BAYTOWN POLICE LIEUTENANT STEVE DORIS STARTED HIS LAW ENFORCEMENT CAREER IN 1992 WITH THE MONTGOMERY COUNTY CONSTABLE'S DEPARTMENT, WHERE HE SPENT SEVEN YEARS AS A HIGHWAY DRUG INTER EVICTION OFFICER AND A CANINE HANDLING.

IN 1999, STEVE CAME TO WORK FOR THE BAYTOWN POLICE DEPARTMENT, SPENDING HIS FIRST TWO YEARS AS A PATROL OFFICER AND A FIELD TRAINING OFFICER.

HE WAS LATER ASSIGNED TO THE CRIMINAL INVESTIGATIONS DIVISION WHERE HE SERVED AS A LEAD INVESTIGATOR ON HUNDREDS OF INVESTIGATIONS AND INVOLVING PROPERTY CRIMES, FRAUD, HOMICIDES, AND NARCOTIC RELATED OFFENSES.

IN ADDITION, HE WORKED WITH THE HARRIS COUNTY ORGANIZED CRIME UNIT IN AN UNDERCOVER CAPACITY INVESTIGATING NARCOTIC AND ORGANIZED CRIME RELATED OFFENSES AND DRUG TRAFFICKING ORGANIZATIONS.

IN 2009, STEVE PROMOTED TO THE RANK OF SERGEANT WHERE HE SPENT A YEAR AS A PATROL SERGEANT.

A YEAR LATER, STEVE RETURNED TO THE CRIMINAL INVESTIGATIONS DIVISION AS A DETECTIVE SERGEANT OVER THE SPECIAL OPERATIONS UNIT OVERSEEING ALL NARCOTIC GANG AND VICE RELATED INVESTIGATIONS AND UNDERCOVER OPERATIONS.

IN 2015, STEVE PROMOTED TO THE RANK OF LIEUTENANT AND FOR THE FIRST YEAR IN THIS RANK, HE WAS ASSIGNED AS A JAIL DIVISION COMMANDER.

ONLY A YEAR LATER, ONCE AGAIN, LIEUTENANT DORIS WAS BACK IN THE CRIMINAL INVESTIGATIONS DIVISION, WHERE HE SERVED AS THE CRIMINAL INVESTIGATIONS DIVISION COMMANDER, AS WELL AS THE DEPARTMENT'S PUBLIC INFORMATION OFFICER.

IN MARCH OF 2021, LIEUTENANT DORIS RETURNED TO THE PATROL DIVISION WHERE HE CURRENTLY SERVES AS ADMINISTRATIVE LIEUTENANT FOR THE OPERATIONS BUREAU AND PROGRAM MANAGER FOR THE BAYTOWN POLICE DEPARTMENT'S STRATEGIC PLANNING PROGRAM.

LIEUTENANT DORIS HOLDS A MASTER PEACE OFFICER CERTIFICATION AND IS A 2015 RECIPIENT OF THE FEDERAL BUREAU INVESTIGATION LAW ENFORCEMENT EXECUTIVE DEVELOPMENT ASSOCIATION'S TRILOGY AWARD, AS WELL AS A GRADUATE OF THE 275TH SESSION OF THE FBI NATIONAL ACADEMY.

THROUGHOUT HIS CAREER WITH BAYTOWN, LIEUTENANT DORIS HAS SUPPORTED OPERATIONS WITH OVER 20 YEARS OF PROGRESSIVE INVESTIGATIVE EXPERIENCE, AS WELL AS SERVING IN VARIOUS CAPACITIES WITHIN PATROL, INCLUDING PATROL WATCH, COMMANDER FIELDING TRAINING, PROGRAM COORDINATOR, AND MENTAL HEALTH UNIT COORDINATOR.

UH, THIS PROJECT WILL INCLUDE COMPLETELY REHABBING THE INTERIOR OF THE UNITS, UH, IMPROVING ACCESSIBILITY, REPAIRING PAVEMENT AND SIDEWALKS UPDATE, UPDATING THE PLAYGROUND AND OFFICE.

I'M GONNA COMMENT ON THAT, AND IT'S NOT WITH, IT'S NOT FROM YOUR COMMENT, BUT THERE IS SOMETHING THAT I'M PARTICULARLY PROUD THAT WE ARE ACTUALLY TAKING ACTION AND THAT THIS IS BEING FUNDED AND PARTICULARLY, AND I'M SURE, UH, UH, COUNCILMAN LESSER WOULD, UH, WOULD ALSO ENJOY THIS, BUT THE DAN, THE DAN NINA AREA DRAINAGE SYSTEM IMPROVEMENTS, AND SO THAT IS A $40 MILLION THING PROBLEM.

UH, I WILL SAY WE, WE MET WITH OUR COUNTY COMMISSIONER, BROUGHT 'EM OUT HERE, AND IT, IT ALL THAT ASSOCIATED WITH THE FLOODING INTO THE FELL STREET AREA, I KNOW IT MET WITH THOSE RESIDENTS IN I THINK END OF 2019.

UH, AND IT WASN'T JUST SOMETHING THAT WE CAN JUST KIND OF JUST CLEAN OUT SOME DITCHES AND OTHER THINGS.

SO I'M JUST HAPPY TO SEE THAT, THAT, UH, A LOT OF THE DRAINAGE ISSUES ARE BEING ADDRESSED AND PARTICULARLY THAT'S WHY I DO SUPPORT THIS TYPE OF CIP, UH, ACTIVITIES AND CERTAINLY THE, THE FUNDING SOURCES FOR THEM.

UH, AND I THINK THERE'S A MULTITUDE OF A LOT OF INFRASTRUCTURE THAT IS SORELY NEEDED IN OUR CITY.

AGAIN, I DO, I DO RELY ON BOTH THE CIP AND FINANCE COMMITTEE, AND I DO RESPECT EVERYONE'S WISHES.

UH, BUT WITH THAT SAID, UM, WE'LL MOVE ON TO, I GUESS, UH, THE, THE, THE ITEM WOULD BE TO APPROVE THESE, UH, THE FUNDING SOURCE.

SO, UM, I JUST WANTED TO NOTE THAT AS WELL.

AND AGAIN, I MEAN, STORMWATER UTILITY AND JUST DRAINAGE IS, IS SOMETHING THAT WE CONTINUE TO BATTLE, BUT YOU LOOK AT AREAS OF TOWN, SOUTH, MAIN REPUBLIC, WEST, TEXAS AVENUE, WEST BAYTOWN, DRAINAGE, AND DAMINA, THOSE ARE KEY AREAS THAT WE CONTINUE TO, TO STRUGGLE WITH AND THIS WILL CERTAINLY HELP THOSE ISSUES.

SO, UH, WITH THAT, UH, YES, COUNCILMAN, I JUST WANT TO ADDRESS WHAT MY COLLEAGUE SAID.

YOU KNOW, I, I UNDERSTAND THAT, YOU KNOW, SEE, YOU DON'T WANNA SEE COS USED FOR, UM, NOTHING BUT NON-EMERGENCY, BUT THESE ARE NECESSARY IMPROVEMENTS THAT OF, UH, MAINTENANCE THAT'S WELL OVERDUE AND, UM, IT, IT'S, IT'S A NEED THAT THE CITY'S BEEN NEEDING FOR A LONG TIME.

SO, UM, I'M THE FULL OF SUPPORT OF THIS, THIS BOND.

GOOD EVENING, JUDGE STRINGER, CHIEF POLICE BAYTOWN, UH, POLICE DEPARTMENT.

UH, SINCE PASSING THE 2001 TEXAS RACIAL PROFILING LAW, THE BAYTOWN POLICE DEPARTMENT HAS COMPLIED WITH THIS LAW COLLECTING DATA FROM TRAFFIC STOPS FOR THE PURPOSE OF IDENTIFYING AND ADDRESSING ANY IDENTIFIABLE CONCERNS REGARDING RACIAL PROFILING PRACTICES WITHIN THE DEPARTMENT.

THE BPD, LIKE OTHER AGENCIES WHO CONDUCT TRAFFIC STOPS AND TRAFFIC ENFORCEMENT IS REQUIRED TO REPORT CONTACT INFORMATION FOR ALL MOTOR VEHICLE STOPS REGARDLESS OF THE DISPOSITION.

EXCUSE ME.

THE INFORMATION CONTAINED IN THIS REPORT REFLECTS DATA AND ANALYSIS OF TRAFFIC STOPS CONDUCTED BY THE AGENCY IN THE CALENDAR YEAR OF 2023.

BODY-WORN CAMERAS ARE ALSO ISSUED TO ALL PATROL OFFICERS, WHICH RECORDS THE SAME DATA AND THE SAME ENCOUNTERS.

IN ADDITION TO THIS, THE BPD PROVIDES REQUIRED TRAINING IN ANTI-BIAS, RACIAL PROFILING, AND CULTURAL DIVERSITY TO ALL PERSONNEL.

THESE DIGITAL RECORDINGS ARE PERIODICALLY REVIEWED TO ENSURE THAT OFFICERS CONTINUE TO ADHERE TO THE DEPARTMENT'S POLICIES AND PROCEDURES, INCLUDING THOSE REGARDING RACIAL PROFILING AND TRAFFIC ENFORCEMENT.

AUDIO AND VIDEO RECORDINGS ARE DIGITALLY MAINTAINED FOR NO LESS THAN 90 DAY PERIOD PRIOR TO BEING PURGED FROM THE RETENTION SYSTEM, UNLESS THAT IS REQUIRED FOR EVIDENTIARY PURPOSES, UH, PURPOSES OF COMPLAINTS OF RACIAL PROFILING OR OTHER MISCONDUCT.

THE BPD HAS WRITTEN POLICIES AND PROCEDURES DEFINING AND PROHIBITING ACTS CONSTITUTING BIAS BASED PROFILING, AS WELL AS MECHANISMS FOR REPORTING RACIAL PROFILING OR OTHER MISCONDUCT.

CITIZENS MAY FILE SUCH COMPLAINTS ONLINE VIA THE BAYTOWN POLICE DEPARTMENT'S PAGE ON THE CITY WEBSITE.

COMPLAINTS ARE REVIEWED AND ASSIGNED TO THE APPROPRIATE INTERNAL AUTHORITY FOR INVESTIGATION.

ALL SUPERVISORS ARE RESPONSIBLE FOR ENSURING THAT PERSONNEL ARE FAMILIAR WITH AND IN COMPLIANCE WITH LAWS, RULES, REGULATIONS, AND POLICY AND PROCEDURE.

THE BAYTOWN POLICE DEPARTMENT SERVES A POPULATION OF APPROXIMATELY 84,490 RESIDENTS AS OF 2022.

IT'S ESTIMATED THAT HISPANIC RESIDENTS COMPRISE 52.2% OF OUR POPULATION WITH 28.8% BEING WHITE OR CAUCASIAN, AND 15.6% BEING AFRICAN AMERICAN OR BLACK.

DURING 2023, THE DEPARTMENT CONDUCTED 13,545 STOPS FOR WHICH RACIAL PROFILE DATA WAS COLLECTED IN ACCORDANCE WITH THE LAW.

RESULTS SHOW THAT OF THESE 37.34% OF DRIVERS WERE WHITE OR CAUCASIAN, REFLECTING A 4% INCREASE OVER THE PREVIOUS YEAR.

2022 32.93% OF THE DRIVERS WERE HISPANIC, WHICH IS A 5% DECREASE FROM THE SAME TIME LAST YEAR.

AND 28.05% OF DRIVERS WERE BLACK, WHICH IS UP 1% AND 93.45% OF THESE STOPS.

THE RACE OF THE DRIVER WAS NOT KNOWN TO THE OFFICER PRIOR TO THE TRAFFIC STOP.

TOTAL SEARCHES, WHETHER THEY WERE CONSENSUAL OR NON-CONSENSUAL, WERE CONDUCTED IN 1,460 OR 11% OF THESE TOTAL ENCOUNTERS.

MOST SEARCHES DURING A TRAFFIC STOP WERE PERFORMED AS AN INCIDENT TO ARREST OR ON, OR 47% OF THE 1,460 SEARCHES.

ARREST OCCURRING FROM A TRAFFIC STOP ARE GENERALLY, GENERALLY THE RESULT OF VIOLATIONS THAT WOULD IN GOOD CONSCIENCE PROHIBIT THE OFFICER FROM ALLOWING THE PERSON TO CONTINUE ON OTHER TRAFFIC ARRESTS ARE THE RESULT OF THE DRIVER BEING FOUND TO BE WANTED BY THIS OR OTHER AGENCIES FOR OUTSTANDING WARRANTS.

SEARCHES BASED ON PROBABLE CAUSE COMPRISE 28% OF THE SEARCHES AND CONSENT SEARCHES ACCOUNT FOR ANOTHER 15% OF THESE SEARCHES.

OUT OF THESE 13,545 TRAFFIC STOPS, 1065 OR 8%, EXCUSE ME, RESULTED IN ARREST.

THE LEADING CALLS FOR ARREST WERE VIOLATION OF THE PENAL CODE, VIOLATION OF TRAFFIC LAW OR OUTSTANDING WARRANTS RESPECTIVELY.

OF THESE 40% OF THE SUBJECTS

ARRESTED WERE WHITE OR CAUCASIAN, 32% WERE BLACK AND 27% WERE HISPANIC.

THAT'S WHAT YOU SEE IN THE PROJECT DURING THE DAY.

SO, UH, WE'RE GONNA HAVE SOME TRAFFIC ISSUES GOING IN AND OUT THROUGH THERE, BUT THAT IS WHAT'S HAPPENING RIGHT NOW.

THEY'RE, THEY'RE, THEY'RE GETTING THAT IMPROVEMENT CLEANED UP AND FIXED.

UH, WE ALSO HAVE THE, UH, SIDEWALK PROJECT, WHICH IS ABOUT TO BEGIN.

THAT'S RUNNING BETWEEN DECK ON DECKER DRIVE BETWEEN ROLLING BROOK AND BAKER.

THAT KIND OF AFFECTS DISTRICT THREE AND DISTRICT FOUR 'CAUSE WE SPLIT THAT ROAD.

UM, OF COURSE WE ALSO, YOU'LL STARTING TO SEE THE WIDENING ON GARTH ROAD, THE UTILITIES AND ALL THAT'S COMING IN.

SO THAT'S THAT, THAT PROJECT'S BEGINNING AND WE'LL START SEEING THAT COMING OFF IN THE NEXT COUPLE OF YEARS AND HOW THAT'S GOING ON.

I KNOW RIGHT NOW WE HAVE THE, UH, TODAY BASKIN, THEY PUT UP THE SIGN FOR THE NEW BASKIN ROBBINS AND UH, AND DUNKING DONUTS RIGHT THERE WHERE, RIGHT THERE OFF OF GARTH IN FRONT OF MY NEIGHBORHOOD.

UM, AND THEN ALSO I KNOW THERE'S A NEW, UH, JB EATERY, WHICH IS COMING RIGHT THERE AT UH, ON BAKER ROAD.

UH, HE INVITED ME OUT TO HIS RESTAURANT THAT ACTUALLY HAVE 12 FRANCHISES IN THE CITY OF HOUSTON.

UH, IT'S ACTUALLY PRETTY GOOD FOOD AND HE DOES HAVE, HE SAID HE HAD, IF THAT ONE GOES WELL, HE PROBABLY WILL BE PUTTING ANOTHER ONE ON GARTH ROAD.

SO THERE'S SOME OF THOSE, THOSE NEW THINGS THAT ARE COMING IN, PLACES TO EAT, PLACES TO TRY.

SO WE'LL BE PREVENT OUT WITHOUT PROMOTING SOME OF THOSE STUFF AND THINGS LIKE THAT.

UM, I KNOW THERE'S SOME NEW TRAFFIC IMPROVEMENTS THAT ARE ALREADY HAPPENING THAT WE'RE START SEEING ON GARTH ROAD THAT'S GONNA BE RIGHT THERE BETWEEN BIRDSONG AND BAKER ROAD, UH, RIGHT THERE.

'CAUSE A LOT OF, WE HAVE THE ISSUE OF PEOPLE TURNING INTO THE KFC AND INTO THE SLOTS.

SO THERE'LL BE A, THERE'LL BE A LIGHT BEING ADDED THERE AND THAT'S BEGINNING, UH, THE IMPROVEMENT NOW.
