UM, I WOULD LIKE TO CALL THE MEETING TO ORDER AND ANNOUNCE THAT WE DO HAVE A QUORUM.

[a. Consider a resolution authorizing Change Order No. 13 with Pepper Lawson Waterworks, LLC, for the BAWA 6 MGD Surface Water Treatment Plant.]

RESOLUTION AUTHORIZING CHANGE ORDER NUMBER 13 WITH PEPPER LOSS AND WATERWORKS LLC FOR THE BALL WITH SIX MGD SERVICE WATER TREATMENT PLANT.

GOOD AFTERNOON.

THIS, UH, CHANGE ORDER IS THE LAST CHANGE ORDER THAT WILL BE APPROVING FOR THE CONTRACT.

IT'S A LITTLE BIT DIFFERENT THAN THE OTHER CHANGE ORDERS THAT WE HAD BROUGHT IN FRONT OF YOU.

THIS IS SOME SUMMARY OF ITEMS THAT, UH, WERE NOT ABLE TO BE RESOLVED EARLIER IN THE PROJECT.

BUT THROUGH A LOT OF, UM, WORK THAT WE'VE SET FORTH EARLY ON IN THE PROJECT, WE BUILT A GOOD RELATIONSHIP WITH THE CONTRACTOR AND WE WANNA BE VERY, UH, FAIR AND WE'VE HAD A GOOD PRODUCT PROVIDED BY THE CONTRACTOR.

AND SO I'LL JUST WALK THROUGH THESE, UH, VERY QUICKLY.

I JUST WANTED TO PREFACE IT BY SAYING, UH, WE BELIEVE THE CONTRACTOR'S BEEN VERY FAIR WITH US.

SO THE FIRST ITEM OF WORK IS REALLY TO COMPLY WITH THE WIND LOAD.

AND EARLIER ON WE HAD BROUGHT A CHANGE ORDER NUMBER 10 THAT WAS PART OF THE STRUCTURAL MODIFICATIONS TO THE OPERATIONS BUILDING SO THAT THAT BUILDING DOES COMPLY WITH WIND LOAD THAT WE NEED TO.

UM, AND IT IS A LARGE STRUCTURAL STEEL MEMBER THAT WAS ADDED TO THAT BUILDING AND IT'S IN PLACE TODAY.

SO THIS IS TO PAY THE CONTRACTOR FOR THAT COMPONENT.

THE SECOND ITEM IS, UH, RELATED TO TEMPORARY DOORS AND THERE WAS A DELAY IN RELEASING THE DOOR SCHEDULES.

THIS IS THE SCHEDULE THAT TELLS WHAT KINDS OF DOORS AND WHAT MATERIAL AND ALSO THE HARDWARE.

AND SO THE ELECTRICAL GEAR THAT WAS HOUSED WITHIN THESE BUILDINGS, UH, ARRIVED AND HAD TO BE PROTECTED FROM THE ELEMENTS.

AND SO THIS WAS THE BEST METHOD TO PROTECT THAT.

UM, CERTAINLY BETTER THAN OTHER LESSER MATERIALS.

SO THESE WERE METAL TEMPORARY DOORS THAT WERE PROVIDED, UM, BY THE CONTRACTOR.

SO THAT'S THE SECOND ITEM.

UM, THE THIRD ITEM IS HAVING TO DO WITH THE TEMPORARY POWER.

SO YOU ALL MIGHT RECALL IT'S KIND OF OUT IN THE HINTERLANDS OF, OF BAYTOWN AND NOT REALLY REACHABLE, UH, THAT EASILY.

AND SO THAT ALSO KIND OF PLAYED OUT WITH THE POWER DELIVERY TO THE SITE.

AND THIS IS, UH, A COST THAT'S PREFACED ON THE 10 MONTH DELAY IN ACQUIRING AN EASEMENT TO GET THE PROPERTY, UM, AVAILABLE FOR CENTERPOINT TO BUILD THEIR POWER FACILITIES TO THE SITE.

SO THERE WAS A PROTRACTED AMOUNT OF TIME THAT THE CONTRACTOR WAS OPERATING ON GENERATOR POWER.

AND SO WE'VE HAD, UH, THIS COST, WHICH IS, UH, SUBSTANTIAL, BUT UM, STILL IS REDUCED FROM THE INITIAL REQUEST TO US.

WE'VE HAD THIS COST REVIEWED, UH, BY TWO CONSULTANTS, UH, BOTH FROM A LEGAL STANDPOINT AND THEN FROM A PRACTICAL STANDPOINT OF, YOU KNOW, ARE ALL THE COSTS THAT HAVE BEEN PROVIDED TO US, DO THEY HAVE BACKUP DOCUMENTATION THAT CAN STAND ON ITS OWN? AND SO THESE COSTS THAT WE'VE REVIEWED, UM, AND NEGOTIATED WITH THE CONTRACTOR HAVE, UM, BEEN REVIEWED BY THEM AS WELL.

SO THERE'S BEEN SOME PARALLEL ESTIMATES THAT HAVE BEEN PROVIDED.

SO, UH, JUST TO REALLY QUICKLY WALK THROUGH THE AMOUNTS FOR THE TOTAL, UH, ITEM

NUMBER, UH, PART NUMBER ONE IS $27,460 AND 26 CENTS.

ITEM NUMBER TWO WAS 19,259 AND 38 CENTS.

AND ITEM NUMBER THREE, 330,291 AND 27 CENTS.

SO THAT BRINGS THE, UH, GRAND TOTAL OF THE, THE CHANGE ORDER TO $377,010 AND 91 CENTS.

AND, UH, STAFF RECOMMENDS APPROVAL.

ONE, ONE ABOUT THE DOORS.

I MEAN, SO THAT'S OVER $1,200 A DOOR.

WE'RE NOT TALKING ABOUT STANDARD DOORS, RIGHT? NO, THESE ARE HOLLOW, UM, PROBABLY THE LOWEST RUNG OF DOORS THAT CAN BE FOUND WITH A FRAME.

AND SO THEY'RE A METAL DOOR, UH, BECAUSE THEY WERE EXTERIOR TO THE BUILDINGS AND THESE ARE NOT FINISHED OR PAINTED OR, YOU KNOW, THERE'S NOT REALLY ANYTHING THAT'S, UM, FANCY ABOUT THEM.

THEY WERE JUST COMPLETELY A FUNCTIONAL ITEM TO KEEP RAIN OUT.

OKAY.

AND SECOND QUESTION.

UM, AND I KNOW YOU SAID THAT CONSULTANTS HAVE LOOKED OVER THIS, BUT WITH RESPECT TO THE ELECTRICAL CHARGE, WOULD, CAN WE ASSUAGE SOME OF OUR ANGST OVER THE COST BY THE FACT THAT WE WOULD'VE PAID CENTER POINT ELECTRICITY? AND, AND DO WE HAVE AN IDEA OF WHAT THAT NUMBER MIGHT HAVE BEEN? THE DELTA BETWEEN WHAT WE ARE PAYING AND WHAT WE WOULD'VE PAID HAD WE PROCURED THE EASEMENT? DO WE HAVE ANY CLUE OF WHAT THAT IS? SO THIS, UM, ITEM ACTUALLY WOULD BE THE CONTRACTOR'S COST.

THEY WOULD'VE PAID CENTERPOINT CORRECT? FOR, FOR POWER.

SO WE CAN EVALUATE THAT WITH WHAT THAT WOULD BE SINCE NOW WE HAVE A FUNCTIONING, UM, PROJECT.

BUT THESE WOULD'VE BEEN, FOR EXAMPLE, DURING THE CONSTRUCTION OF THESE CONCRETE BASINS MM-HMM .

THERE'S, UH, POWER TOOLS THAT ARE, YOU KNOW, MEANT TO BE, UM, YOU KNOW, KIND OF FUNCTIONING OFF OF POWER.

SO THOSE WERE ALL GENERATOR.

AND SO, YOU KNOW, NORMALLY THE, THE CONTRACTOR'S COST IS TO INCLUDE THAT, BUT THEN THEY TRANSFER TO, TO ELECTRIC POWER.

SO, WE'LL WE CAN BRING THAT ITEM BACK TO YOU.

UH, IF I THINK IT MAY BE A QUICK CALL JUST TO EVALUATE HOW MUCH MORE WE SPEND IN DIESEL, FOR EXAMPLE, THAN THE ELECTRIC POWER.

AND SO, BUT CONSULTANTS HAVE LOOKED AT THIS AND FOUND THAT IT WAS REASONABLE.

CONSIDER A RESOLUTION AUTHORIZING ACCEPTANCE AND RELEASE OF RETAINAGE TO PEPPER LOSS AND WATER WORKS LLC FOR THE BIBLE SIX MGD SURFACE WATER TREATMENT PLANT.

ALRIGHT, SO THIS IS A MAJOR MILESTONE.

UM, I THINK WE ALLUDED TO THAT WITH OUR RIBBON CUTTING, UH, EVENT, WHICH, UM, YOU KNOW, THAT THAT WAS CERTAINLY A A, A GOOD OCCASION AND THIS KIND OF PUTS THE DOCUMENTATION, UM, INTO THE FINAL MILESTONE.

SO THIS ITEM REPRESENTS THE ACCEPTANCE AND THE ENGINEER HAS WRITTEN, UH, THEIR RECOMMENDATION TO ACCEPT THE PROJECT.

UH, THE PAYMENT INCLUDES THE AMOUNT OF THE CHANGE ORDER THAT YOU HAD JUST PREVIOUSLY APPROVED AND THEN THE RELEASE OF RETAINAGE.

SO, YOU KNOW, FOR A PROJECT THIS LARGE, THAT'S WHY IT'S SUCH A LARGE AMOUNT.

UM, BUT WE TYPICALLY HOLD 5% RETAINAGE.

SO THAT'S THE SUM TOTAL THERE THAT YOU SEE.

AND SO WE WOULD NORMALLY COLLECT ALL OF THE PAPERWORK.

UH, SO WE'VE KIND OF WALKED THROUGH ALL THE CHANGE ORDERS JUST TO KIND OF GIVE AN APPRECIATION, BUT IN, IN SOME THERE WAS A LARGE DEDUCTIVE CHANGE ORDER AND THEN WE INCREASED, UH, THROUGH SEVERAL, BUT WE STILL HAD A NET DEDUCTION ON THE PROJECT, UH, OF OVERALL COST FROM THE ORIGINAL.

UH, SO THE CONTRACT TIME WAS NOT EXTENDED, UM, EITHER, SO THAT MAINTAINED AT THE 1095 DAYS.

SO IN SUM TOTAL, THIS KIND OF BRINGS US FORWARD.

UH, THERE'S STILL WORK THAT WE WOULD DO TO, UM, REPORT ANYTHING THAT WE NEED TO ON FUTURE STUDIES.

AND, UH, A FEW THINGS ON THE DESIGN SIDE WITH THE TCEQ, THERE'S OUR, UH, EQUIPMENT STILL REQUIRES ONE MORE DRAFT REPORT TO BE SENT TO THE TCQ.

BUT ALL OF THE CONSTRUCTION THAT'S SUMMARIZED HERE IS COMPLETE AND IS, UH, IN, IN WORKING ORDER.

AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH OUR DUO GROUP LLC FOR THE BAYTOWN AREA WATER AUTHORITY RAW WATER PUMPS REHABILITATION PROJECT.

ALL RIGHT, SO EMBARKING ON ANOTHER CAPITAL, UH, IMPROVEMENT FOR THE SYSTEM.

AND UH, THIS IS A PROJECT THAT HAS BEEN, UM, ON THE BOOKS AND, UH, WE HAVE, UH, SELECTED THROUGH OUR, UH, QUALIFICATIONS PROCESS.

SO WE HAD, UH, ADVERTISED FOR REQUEST FOR QUALIFICATIONS.

THERE WAS A NUMBER OF FIRMS THAT HAD SUBMITTED AND THROUGH THE REVIEW AND UM, KIND OF QUALIFIED FIRMS THAT HAVE DONE THIS SORT OF WORK OF THIS CAPACITY AND THIS SIZE OF FACILITY, WE WANTED TO BRING FORWARD OUR DURA GROUP.

AND SO THERE'S THREE COMPONENTS OF WORK HERE THAT THEY'RE GONNA BE, UM, ASSISTING US WITH.

THE RAW WATER PUMP SYSTEMS ARE COMPOSED OF TWO DIFFERENT PUMP STATIONS, ONE AT THE CANAL AND ONE AT THE FOUR BAY.

SO THERE ARE SEVERAL PUMPS AT EACH LOCATION AND THEY'RE ALL AT THE END OF SERVICE LIFE AND REQUIRING MORE AND MORE MAINTENANCE MORE FREQUENTLY.

SO IT'S TIME NOW TO EVALUATE FOR REPLACEMENT OF THOSE AND JUST TO STUDY THE PUMP STATIONS AS THEY ARE AND THEY'RE ON PLATFORM.

THE SECOND ITEM IS TO HOUSE THE ELECTRICAL EQUIPMENT.

SO MOTOR CONTROL IS THE LARGER SIZE ELECTRICAL EQUIPMENT AND WE'RE CALLING FOR SOME ELECTRICAL BUILDINGS.

AND SO THAT GOES ALONG WITH OUR PROCESS OF THINKING ABOUT WINTERIZATION AND MAKING SURE THAT THE FACILITIES CAN WITHSTAND SOME OF THE MORE EXTREME TEMPERATURES THAT WE'RE SEEING.

THE OTHER COMPONENT IS THE FOUR BAY LINER, AND THIS IS A GEO MEMBRANE LINER THAT IS LIKE AN HDPE PLASTIC LINER AND OVER TIME HAS SOME HOLES IN IT.

SO THAT COULD BE ANYTHING FROM ANIMALS FALLING IN.

WE'VE HAD AN OCCURRENCE WHERE THERE WAS A CAR THAT KIND OF LANDED IN THE, UM, FORAY AND THERE'S SOME DAMAGE THAT WE'RE SEEING.

UH, THE BYPRODUCT OF THAT IS SOME WEEPING AND SOME WETNESS ON THE OUTSIDE.

SO OVER TIME THAT'LL INCREASE.

AND WHAT WE WANT TO DO IS REPAIR THAT TO MAKE THAT, UH, FACILITY MORE WATERTIGHT.

SO WE'RE CONSIDERING, UH, THE TYPES OF LINER MATERIALS AND LOOKING AT ALL THE LINER MATERIALS AND THEN EVALUATING FOR WHAT WE HAVE CURRENTLY.

THE LAST, UH, COMPONENT IS A SMALLER STUDY AND THAT'S TO GET US READY FOR THE NEXT PHASE, WHICH IS A CAPITAL IMPROVEMENT PRO, UH, PROJECT FOR THE DECAMP PUMP STATION.

WE'RE HAVING SOME OPERATIONAL DIFFICULTIES AND WE JUST WANNA TAKE A CLOSER LOOK AT THAT AND HELP US GET TO THE NEXT STAGE WITH SOME, UH, ENGINEERING EVALUATION.

MORE OF A TECHNICAL STUDY THAN ANYTHING THAT WOULD BE, UH, CAPITAL IMPROVEMENT OR CONSTRUCTION BASED.

SO THOSE ARE THE COMPONENTS OF THE PROJECT.

AND THE DESIGN PORTION, UH, FOR THE ENGINEER IS 612,000 ROUNDABOUT, UH, THE BID PHASE THAT THEY'LL BE ASSISTING US WITH.

AND WE'LL GO THROUGH THE COMPETITIVE SEAL PROPOSAL PROCESS AS WE'VE BEEN DOING WITH SOME OF OUR, UH, PROJECTS LATELY.

AND THEN THERE, CONSTRUCTION ADMINISTRATION PHASE, UH, SERVICES ABOUT 139,000.

SO THIS IS THE ENGINEERS PORTION.

IN THE FUTURE WE'LL BRING FORTH A CONTRACT FOR CONSTRUCTION MANAGEMENT IF THAT'S NEEDED, BUT THIS IS ONLY THE DESIGN ENGINEERS PORTION OF THE WORK.

SO THE SUM TOTAL OF THIS PROJECT, UH, PARDON ME, THIS DESIGN CONTRACT IS 789,170 AND 6 CENTS.

UM, AS WE THINK WE WILL BE MOVING FORWARD FAIRLY QUICKLY WITHIN THE NEXT 10 DAYS, UH, TO START THE PROJECT AND GET GOING ON DESIGN.

FIVE FIRMS SUBMITTED AND THIS WAS THE MOST QUALIFIED FIRM.

AND AND YOU'RE TAKING INTO ACCOUNT THE WINTERIZATION, LIKE YOU SAID.

THAT'S, THAT'S TRUE.

SO WE'RE TRYING TO MAKE SURE THAT OUR FACILITIES HAVE A RESILIENT, MORE RESILIENT NATURE.

AND SO WE EXPERIENCED SOME ISSUES, NOT A WHOLE LOT OF ISSUES DURING THE WINTER FREEZE AT THE PUMPS, BUT JUST TO MAKE SURE WE COVER THAT,

UH, THAT'LL BE INCLUDED IN THIS BECAUSE DIDN'T WE FIND DURING THE POWER OUTAGE THAT WE LOST POWER AT THE PUMPS WHERE WE WERE PUMPING WATER INTO OUR, UH, BAY OR WHATEVER FROM THE CANAL EXCUSE? UM, THE POWER OUTAGE, UH, THAT YOU'RE UH, REFERENCING, UM, WAS A, UH, INTERRUPTION TO THE WHOLE PLANT PROCESS.

UM, SO THERE WERE SEVERAL AREAS WHERE WE COULD NOT FEED WATER DURING THAT, THAT SHORT WINDOW SPAN.

THE, THE ISSUES SUBSEQUENTLY AFTER THAT WERE NOT RELATED TO POWER, MORE RELATED TO TEMPERATURE, RIGHT.

BUT THEY, BUT I THOUGHT IT WAS THAT THEY DIDN'T HAVE BACKUP POWER TO PUMP WATER FROM THE CANAL INTO THAT BIG FOUR BAY.

THEN THAT FEEDS YOUR NORMAL PROCESSES.

BUT THEY'VE WORKED WITH US ON HOW THAT WOULD BE IMPROVING OUR PROCESS, HOW MUCH LESS IT WOULD BE FOR LIFECYCLE COSTS AND I THINK THEY'RE GONNA APPLY THAT SAME, UH, PHILOSOPHY TO THIS DESIGN PROJECT.

I BELIEVE THAT'S THE LARGEST PROJECT THE CITY HAS UNDERTAKEN CITY OR BAWA HAS UNDERTAKEN IN ITS HISTORY.

UM, SO VERY IMPRESSIVE, ALL THE MANAGEMENT AND YES, THERE WERE A NUMBER OF CHANGE ORDERS, BUT ALL THINGS CONSIDERED VERY WELL MANAGED FROM OUR STAFF STANDPOINT.

SO, UH, APPRECIATE TO THEM, UH, APPRECIATION TO YOU ALL FOR THE VISION AND, AND, UH, OVERSIGHT THROUGHOUT THE PROJECT.
