UH, AND IMPORTANT CONSIDERATION FOR THIS APPLICATION, UH, IS IF THE PROPERTIES WERE TO BE REZONED FROM NSC TO GC AS WHAT IS BEING REQUESTED TONIGHT, UM, THOSE BOTH BEING COMMERCIAL ZONES, THE QUESTION BECOMES WHAT USES WOULD THEN BE ALLOWED THAT AREN'T ALLOWED TODAY. UM, IN REVIEWING THE APPLICATION, STAFF FELT THAT THE REQUEST GENERALLY MET THE CRITERIA LAID OUT BY THE CODE FOR REZONE. UH, BUT THROUGH THE PUBLIC HEARING PROCESS HELD BY P AND Z, UH, SEVERAL OF THE NEIGHBORS CAME OUT AND EXPRESSED THEIR DISAGREEMENT WITH THE APPLICATION AND WITH STAFF. UM, ONE OF THE MAIN ARGUMENTS FROM THE NEIGHBORS IS THAT THEY WOULD PREFER THIS AREA STAY ALL RESIDENTIAL TO STAY COMPATIBLE WITH THE CURRENT USES AND NEWER HOMES THAT HAVE BEEN BUILT ALONG CEDAR BY YOUR ROAD. AGAIN, REMEMBER, IT'S ALREADY ZONED TO A NEIGHBORHOOD LEVEL COMMERCIAL, SO THEIR, THEIR PREFERENCE WOULD BE FOR IT TO BE SINGLE FAMILY. UM, AND I'M ASSUMING YOU'LL HEAR SOME OF THAT TONIGHT. UM, AS A RESULT OF THIS INFORMATION AND THE TESTIMONY THAT WAS HEARD AT THOSE TWO PUBLIC HEARINGS, THE COMMISSION DID VOTE UNANIMOUSLY TO RECOMMEND DISAPPROVAL TO, UH, CITY COUNCIL. THE MAIN FINDINGS IN FORMING THIS VOTE, UH, WAS THAT THE PROPOSED ZONING IS NOT CONSISTENT WITH THE FUTURE LAND USE PLAN. IT IS NOT COMPATIBLE WITH THE EXISTING SINGLE FAMILY HOMES IN THE AREA. THAT THERE ARE CONCERNS WITH INCREASED TRAFFIC ALONG CEDAR BAY ROAD AND THE POTENTIAL SAFETY ISSUE, SAFETY ISSUES CONCERNING TRUCK TRAFFIC AND SEEING SINGLE FAMILY HOMES, UH, AND THAT THE CONDITIONS IN THIS AREA HAVE NOT CHANGED ENOUGH OVER TIME TO WARRANT A ZONING AMENDMENT. UM, AS A REMINDER TO COUNSEL, UH, THIS PETITION, UH, DOES HAVE A FORMAL OPPOSITION AND HAS BEEN SUBMITTED, MEETS THE REQUIREMENTS. AS YOU'VE HEARD TONIGHT, WITH ACCORDANCE OF THE GUIDELINES AND THE ZONING FIT, THEY FIT, UH, PERFECTLY. DR. DR. WOOTEN STATES HIMSELF THAT THE MOST INTEREST IN HIS PROPERTY HAS BEEN FOR RESIDENTIAL. IT'S UNFORTUNATE THAT DR. WOOTEN DIDN'T CHOOSE TO REACH OUT TO THE NEIGHBORS FOR SUPPORT IN CHANGING THE CURRENT ZONE TO THE MEET THE REQUESTS HE'S RECEIVING. THAT'S TRULY THE DEMONSTRATED COMMUNITY NEED. ALSO THE GC ZONE PROPERTIES IN THE AREA. FAITH ALEXANDER DRIVE IN OUR AREA, NOT CEDAR BAYOU ROAD. AS HOMEOWNERS, WERE PUTTING OUR TRUST IN THIS COUNCIL AND YOUR FAITH IN THE PLANNING AND ZONING COMMITTEE TO DO WHAT'S IN THE BEST INTEREST OF NEIGHBORHOOD OF OUR NEIGHBORHOOD COMMITTEE AND NOT WHAT BENEFITS THE PROFITS OF ONE. I MUST BE HONEST AND TELL YOU THAT WE'RE A BIT SHOCKED. WE STAND HERE TODAY WITH THE POSSIBILITY A PART OF OUR COMMUNITY BEING REZONED TO GENERAL COMMERCIAL. IT WOULD ONLY ENHANCE DR. UM, SO, AND THE EXISTING PLANTS MAY NOT HAVE THE CAPACITY TO, UH, SERVE THE, UH, BUILD OUT OF THIS AREA DEPENDING ON HOW IT DEVELOPS. UM, SO THESE DECISIONS HAVE LARGE ECONOMIC IMPACTS, SO WE WANNA MAKE SURE THAT WE'RE MAKING THE RIGHT DECISIONS. UM, SO THE FIRST PART OF THIS PROJECT WILL BE DEVELOP A STRATEGIC PLAN FOR SERVING AREAS WITHIN THESE TWO, UM, UH, TREATMENT PLANT SERVICE AREAS. NOW, THE SECOND PART OF THE PROJECT IS TO DEVELOP A WASTEWATER MODEL. AND THAT MODEL WILL, UH, REPLICATE HOW OUR WASTEWATER SYSTEM FUNCTIONS DURING RAINFALL EVENTS. UH, THE MODEL CAN HELP US DETERMINE WHICH PARTS OF THE SYSTEM NEED UPGRADES TO ELIMINATE, UH, ELIMINATE SANITARY SEWER OVERFLOWS. IN 2013, THE SITTER CITY ENTERED INTO AN AGREEMENT WITH, UH, TCQ TO DO SPECIFIED PROJECTS WITH THE GOAL OF REDUCING SSOS. THAT AGREEMENT ENDS IN DECEMBER OF 2022, AND THE CITY IS NEARING COMPLETION OF ALL THE PROJECTS UNDER THAT PLAN. UH, SO, UH, I WANT US TO BE PROACTIVE AND DEVELOP A PLAN, UH, TO ELIMINATE SSOS BECAUSE WE STILL ARE HAVING SOME, ALTHOUGH THEY HAVE BEEN REDUCED, UH, BUT DURING HEAVY RAINFALL EVENTS, WE STILL GET SSOS AND, UH, IT'S OUR GOAL TO ELIMINATE THESE.
