AGAIN, AS A PLANNED UNIT DEVELOPMENT, I JUST WANT TO KIND OF GIVE EVERYBODY A REMINDER, UM, THAT THE PLAN UNIT DEVELOPMENT ALLOWS US TO VARY FROM OUR NORMAL REGULATIONS, BUT IN THE PROCESS, IT DOES ALLOW US TO SORT OF DEMAND THAT THE DEVELOPER GIVE BACK SOMETHING A LITTLE BIT HIGHER IN PRODUCT THAN, THAN WE MIGHT OTHERWISE GET.
UM, SO WE LOOK FOR GIVE AND TAKE AND WE TRY TO GET MORE CREATIVE AND BENEFICIAL PRODUCT FOR THE COMMUNITY.

UH, THE CURRENT ZONING IS LIVABLE CENTER, WHICH ALLOWS FOR A MIXTURE OF USES.
UH, AND IT ALSO IS COVERED BY THE SAN JACINTO OVERLAY, WHICH WAS DESIGNED TO SORT OF TIGHTEN UP, UH, THE LOOK AND THE FEEL OF THE DEVELOPMENTS THAT HAPPEN ALONG THAT THE SAN JACINTO CORRIDOR.
UH, THIS PROJECT WILL STILL BE ZONED LC AND WILL ADHERE TO THE OVERLAY STANDARDS, UH, IN THE SANTO OVERLAY.
UM, BUT IT WILL ADD THE PUD OVERLAY TO THAT, WHICH WILL KIND OF, IT WILL CHANGE SOME OTHER THINGS AND WE'LL ADD SOME DESIGN STANDARDS THAT WE COULDN'T OTHERWISE ASK FOR.
THE FUTURE LAND USE PLAN DOES SHOW A SMALL PORTION OF THIS PROPERTY AS LOW TO MEDIUM DENSITY RESIDENTIAL, AND THE MAJORITY OF IT IS HIGH DENSITY RESIDENTIAL.
SO THIS PROPOSED USE, UH, GENERALLY FITS WITH THAT DESIGNATION, UH, THE PLANNING AND ZONING COMMISSION.

UM, THE, THE PLANNING ZONING COMMISSION DID HOLD THE REQUIRED PUBLIC HEARINGS AND DID VOICE SOME CONCERNS.
UH, THE BIGGEST ONES WERE ABOUT MAINTENANCE, UM, THE PERCEPTION OF ADEQUATE PARKING AND HOW WHETHER OR NOT THE, UH, THE, UH, PROPERTY OWNERS WOULD ADEQUATELY, UH, POLICE THAT PARKING SITUATION.
AGAIN, THIS IS ON PRIVATE PROPERTY.
UM, THE, UH, AND SOME OF THAT EFFECT THAT, THAT COULD HAVE ON ACCESS TO EMERGENCY VEHICLES, CONGESTION ALONG NEARBY PUBLIC ROADS.
AND JUST KIND OF AN OVERALL QUESTION ABOUT THE, THE, UM, THE QUALITY OF, OF THE ENTIRE, UM, DEVELOPMENT.
SO I'D LIKE TO TAKE JUST A MOMENT TO SORT OF CLARIFY THE PROPOSED PARKING.
UM, AS YOU CAN SEE, THIS PROPOSAL IS ACTUALLY OVER THE PARKING REQUIREMENT.
IF YOU LOOK IN THE, THE TOTAL AND PARKING THAT, THE GRAY AREA TOWARDS THE BOTTOM, UM, THE TOTAL REQUIRED AT, FROM A REGULAR MULTIFAMILY, OR I SHOULD SAY A, A MORE, UM, COMMON MULTIFAMILY TYPE APARTMENT COMPLEX FOR THAT NUMBER OF UNITS WOULD'VE BEEN 323 PARKING SPACES.
THEY'RE ACTUALLY PROVIDING 369 ON THE, UH, ON THE SITE PLAN THAT WAS PROVIDED TO US.
UM, I UNDERSTAND THERE MIGHT HAVE BEEN SOME CHANGES TO THAT AS WELL.
SO THE, THE APPLICANT CAN KIND PRESENT THAT TONIGHT.
AND WHAT THAT COMES DOWN TO IS OUR PARKING RATIO.
SO PARKING SPACES TO NUMBER OF, UH, OF UNITS IS THE, UH, THE REQUIREMENT IS, IS JUST UNDER TWO.
UM, BUT THEY'RE ACTUALLY PROVIDING, UH, TWO, UH, 2.25, WHICH IS ABOUT 46 SPACES OVER THE REQUIREMENT.
SO I'VE ALSO PROVIDED, UM, EXAMPLES OF THREE NEARBY NEWER APARTMENT COMPLEXES JUST FOR COMPARISON.

UH, THEY DID RECOMMEND BY A SPLIT VOTE THAT YOU DENY THIS PUD REQUEST, UH, EVEN WITH STAFF RECOMMENDATION OF APPROVAL.
SO, UH, THAT SAID, BECAUSE THEY RECOMMENDED DENIAL, JUST A REMINDER TO YOU THAT TONIGHT YOU WILL NEED TWO THIRDS VOTE IN ORDER TO TAKE ANY ACTION ON THIS.

AND AT THAT TIME, WE KNEW THAT WE WANTED TO MAKE A SPECIAL, UNIQUE AREA IN BAYTOWN, SOMETHING THAT WE DIDN'T HAVE.
IT WAS ALSO GONNA, YOU KNOW, RELIEVE SOME TRAFFIC FROM GARTH, BUT WE KNEW WE WANTED MUCH MORE.
SO THEN IN 2019, WE ESTABLISHED A SAN JACINTO, UM, OVERLAY DISTRICT THAT, UM, SOLIDIFIED OUR DESIRE ON HEIGHTENED STANDARDS IN THAT AREA.
IN THAT SAME TIMEFRAME, BAYTOWN ADDED ABOUT 5,000 OR SO SINGLE FAMILY OR MULTIFAMILY UNITS OF HOUSING, EITHER PLATTED UNDER CONSTRUCTION, UH, BUILT OR, UM, IN SOME SORT OF OVERLAY PLAN, UM, TO, TO BAYTOWN.
BUT ALL OF THOSE UNITS WERE EITHER SINGLE FAMILY DETACHED OR MULTI-FAMILY GARDEN STYLE APARTMENTS.
AND SO WHAT WE KNEW WE USED TO CALL IT A COUPLE YEARS AGO WAS THAT MISSING HOUSING THAT WE DIDN'T HAVE HERE IN BAYTOWN.
AND SO WHAT YOU HAVE IN SAN JACINTO COTTAGES IS WE'VE BROUGHT ALL OF THAT TOGETHER IN THIS ONE PROJECT.
IT IS UNIQUE, IT IS OF HIGH QUALITY.
UH, IT IS LOCATED IN THE SPOT IN THE THIRD TIER OF THE SAN JACINTO OVERLAY, WHICH WE SAID WE WANTED TO HAVE DENSE HOUSING.
UM, WE'VE ALSO UTILIZED, WHICH WE'LL SEE ON YOUR AGENDA, UM, EXISTING DETENTION FACILITY, UM, IN THE SANTO OVERLAY.
WE, UH, THE CITY AT THAT TIME SAID WE DID NOT WANT TO HAVE A LOT OF DETENTION PONDS.
SO THERE WAS AN EXISTING CITY FACILITY, UH, DETENTION THAT IN, UM, THIS OVERLAY AND AN AGREEMENT YOU HAVE BEFORE YOU TONIGHT WE WILL, OR THE, THE PROJECT WILL IMPROVE AMENITIZE CREATE A WALKING TRAIL THAT WILL SEND, UM, WILL ALLOW JUST THE GENERAL PUBLIC TO ACCESS FROM SAN JA SINO BOULEVARD'S TRAIL.
THE OTHER THING THAT WE DID IS KNOWING THAT SAN SINO BOULEVARD WOULDN'T HAVE A LOT OF ACCESS POINTS AND SO FORTH, BECAUSE WE WERE NOT CREATING ANOTHER GARTH ROAD.
UM, WE CHANGED OUR LAND PLAN SO THAT WE CAN LINE UP WITH AN EXISTING, UM, INTERSECTION THAT WAS ALREADY BUILT INTO SAN JACINTO.
AND TO MAKE THAT HAPPEN, THIS, UM, THE PROJECT TEAM IS PURCHASING LAND, WHICH AGAIN, IS ON YOUR AGENDA TONIGHT, PURCHASING LAND THROUGH THE PUBLIC BID FOR OUR GRAND ENTRYWAY AND SIGNAGE, JUST SO THAT WE CAN, CAN UTILIZE THE EXISTING, UM, CUT THAT YOU HAVE ON SANS BOULEVARD.

AND SO WHAT I REALLY WANTED TO POINT OUT IS THAT PRETTY MUCH EVERY SINGLE COMMENT ALLUDED TO THE FACT THAT THIS WAS GOING TO BE LOW INCOME HOUSING, THAT THEY KEPT REFERRING TO THEM AS APARTMENTS, AND THAT WE DON'T NEED ANY MORE LOW INCOME HOUSING.
UM, THIS IS FAR BEYOND LOW INCOME HOUSING.
UM, UH, I BELIEVE THE, THE UNITS, AND Y'ALL CAN CORRECT ME IF I'M WRONG, WILL RUN ANYWHERE BETWEEN 1400 TO $2,000 IN RENTAL FEES.
SO FOR THOSE THAT CONSIDER THAT LOW, LOW INCOME, WELL THAT'S FAR BEYOND WHAT I WOULD PAY.
SO, UM, I I THINK THAT I JUST WANTED TO ADDRESS THAT BECAUSE I KNOW THAT WE, WE REALLY LOOK AT OUR PUBLIC COMMENTS AND MAKE SURE THAT, YOU KNOW, WE, WE HEAR THE, THE PUBLIC THAT WE ACKNOWLEDGE WHAT THEIR CONCERNS ARE.
BUT I, I THINK THIS PROJECT ITSELF HAS REALLY PROVEN THAT IT IS NOT LOW INCOME.
UM, IT'S NOT CONSIDERED IN, IN MY MIND, UM, APARTMENT COMPLEXES AND, UM, EVEN PNZ, UH, THEMSELVES BACK IN, UH, NOVEMBER OF 18, UH, APPROVED THIS OVERLAY OR THIS PARTICULAR PROJECT WOULD ACTUALLY BE ALLOWED.
AND SO THEN IT CAME TO CITY COUNCIL IN MARCH OF 2019 BASED OFF OF P Z'S RECOMMENDATION.
SO, UM, I JUST WANTED TO STATE THAT.
MAYOR, I JUST QUALIFIED THAT THOSE COMMENTS WERE FROM OUR BAYTOWN ENGAGE SITE MM-HMM
UM, WHICH, SO WE, WE'VE BEEN TAKING THOSE, THOSE COMMENTS AND I BELIEVE THE MAJORITY OF THOSE CAME IN PRIOR TO THE FIRST PUBLIC HEARING.
SO IT WAS BEFORE PEOPLE REALLY GOT A, A, A CHANCE TO, TO SEE WHAT IT WAS WAS BEING, UH, PROPOSED.

YOU DON'T SEE THE ISSUES THAT WE HAVE ON OUR PUBLIC STREETS IN AN APARTMENT COMPLEX, PROBABLY FOR TWO REASONS.
IT'S PRIVATELY OWNED AND THE INDIVIDUALS KNOW IF THEY DON'T DO AS ASKED, THOSE CARS WILL BE TOWED SO MUCH SO THAT THEY DON'T EVEN PARK THEIR CARS WITH THE EXHAUST FACING THE APARTMENT BECAUSE IT

UH, AND AGAIN, AFTER I EXPLAINING IT AND, AND I HAVE TO, TO AGREE WITH COUNCILMAN JOHNSON THAT IT'S HAVEN'T BEEN HERE THAT LONG, BUT IT'S REFRESHING TO SEE A DEVELOPER COME IN AND JUST VOLUNTARILY EXCEED OUR REQUEST AND REQUIREMENTS INSTEAD OF US PUSHING THEM OR ARGUING WITH THEM AND, AND FIGHTING WITH THEM ON EVERY LITTLE BIT.

SO, YOU KNOW, WE, I'M NOT GONNA GO THROUGH THE NUMBER OF PROJECTS THAT ARE WITHIN A HALF MILE OF, OF THIS SITE, BUT THERE, THERE'S, THERE'S TWO OR THREE AND THERE'S TWO OR THREE MORE WITHIN A MILE THERE.
THERE'S APARTMENTS UNDER CONSTRUCTION JUST DOWN GARTH ROAD.
THERE'S ANOTHER PUD THAT WE APPROVED, CROSBY, CEDAR BIO ROAD, UM, WITH ANOTHER LARGE SCALE MULTI-FAMILY PROJECT.
AND I, I HAVEN'T MENTIONED THE 600 THAT ARE PITCHED OUT AT THE MALL SITE AS WELL.
SO, YOU KNOW, LIKE I SAY, I, I, YOU KNOW, AND I SEE THE 20 ACRE LAKE THERE ON THE, ON THE SITE PLANTER, THE AERIAL, AND, YOU KNOW, I JUST, I HAVE A SOMEWHAT OF A BACKGROUND IN REAL ESTATE AND YOU KNOW, IT IS GONNA BE, I, I SEE THAT AS A, UH, AS AN OPPORTUNITY ON ONE HAND, BUT YOU KNOW, IT'S GONNA BE SURROUNDED BY THREE RENTAL PROPERTIES OR IN THREE RENTAL PROJECTS NOW.
SO, YOU KNOW, I JUST KIND OF VIEW THAT AS A MISSED OPPORTUNITY IN, IN SOME WAY.

AND THEN THE OTHER PART IS, UH, SECTION 42 DASH 1 53.
IT'S, UH, INCLUDES THE MOBILE FOOD ESTABLISHMENTS AND SPECIFICALLY AFFECTED, UH, IN THIS PARTICULAR SECTION IS SUBSECTION C3.
UM, WHAT WE HAVE ARE TWO AMENDMENTS.
ONE OF THEM WILL EXPAND THE DEFINITION, THE CURRENT DEFINITION OF A MOBILE FOOD UNIT TO INCLUDE THE FOLLOWING, AN ENCLOSED TRAILER USED FOR THE PREPARATION, SALE OR DONATION OF ONSITE PREPARED FOODS.
AND THE SECOND AMENDMENT TO THE ORDINANCE WILL EXTEND THE OPERATIONAL HOURS OF THE LOCATION WHERE THE MOBILE FOOD UNIT CAN BE SET UP FROM SIX TO 12 HOURS.
SO WITH THESE CHANGES, THE MOBILE FOOD UNIT DEFINITION WILL NOW READ AS FOLLOWS.
MOBILE FOOD UNIT SHALL MEAN A FOOD SERVICE ESTABLISHMENT THAT IS A VEHICLE MOUNTED SELF-PROPELLED UNIT OR AN ENCLOSED TRAILER USED FOR THE PREPARATION, SALE, OR DONATION OF ONSITE PREPARED FOOD AND IS CAPABLE OF BEING READILY MOVABLE.
THE OTHER SECTION THAT'S AFFECTED 42 DASH 1 53 SUBSECTION C3, UH, IS, IS QUITE A SIMPLE, UH, REVISION.
WHAT WE DID WAS WE REMOVED THE WORD SIX AND REPLACE IT WITH THE WORD 12.
SO AS WE LOOK AT THAT PARTICULAR, UH, SECTION, THE SECOND TO LAST SENTENCE WILL NOW READ.
NO MOBILE UNIT MAY OPERATE FOR MORE THAN 12 HOURS AT ANY LOCATION OTHER THAN CITY DESIGNATED MOBILE FOOD UNIT AREAS WITHIN THE ACE ZONING DISTRICT OF THE CITY.
UM, IT'S VERY STRAIGHTFORWARD.
IN SUMMARY, ONE AMENDMENT EXPANDS THE DEFINITION OF MOBILE FOOD UNITS TO INCLUDE ENCLOSED TRAILERS, AND THE SECOND AMENDMENT EXTENDS THE OPERATIONAL HOURS WHERE A MOBILE FOOD UNIT CAN SET UP TO 12 HOURS, WHERE IT'S CURRENTLY SIX.

30,000 PEOPLE ARE EMPLOYED BY THESE TRUCKS SLASH TRAILERS.
IT IS A $1.4 BILLION INDUSTRY WITH THE PROJECTION OF 2.4% GROWTH THIS YEAR.
SO THIS IS, THIS IS ON THE MOVE.
MILLENNIALS ARE THE MAJORITY OF THE CONNOISSEURS AT 47%.
PEOPLE AGES 18 TO 34 ARE THE TYPICAL ONES THAT WANT TO GRAB A MEAL FROM A FOOD TRUCK, BUT FOLLOWED BY THE 35 TO 44 AGE GROUP.
AND I AM OVER 44, SO THAT'S NOT A GOOD STATISTIC, I'M JUST SAYING.
SO, UM, 80% OF FOOD TRUCK DINERS CHOOSE TO EAT THERE BECAUSE THEY FIND IT EXCITING NEW AND A UNIQUE EXPERIENCE.
AND 90% OF THOSE PATRONS RATE THEIR EXPERIENCE POSITIVELY.
UM, 30% ARE OWNED BY IMMIGRANTS, WHICH IS SUPER COOL BECAUSE IT ALLOWS A LOT OF A VARIETY, A LOT OF FOODS THAT CAN COME INTO THE CITY THAT WE DON'T NECESSARILY HAVE BRICK AND MORTAR FOR.
